Absent: Chairperson Nixt and Commissioner Brauer. <br /> <br />Case #2: <br /> <br />Request to Rezone Property From B-1 Business and R-1 Single Family <br />Residential to R-1 Single Family Residential, R-3U Residential, and Multiple <br />Residential; Case of Royal Oaks Realty, Inc. <br /> <br />Case #3: Request for a Preliminary Plat of The Ponds; Case of Royal Oaks Realty <br /> <br />Vice Chair Kociscak closed the regular portion of the Planning Commission meeting at 7:15 p.m. <br />in order to call the public hearing to order. He noted that public hearings for Cases #3 and #4 <br />will be held simultaneously. <br /> <br />Public Hearing <br /> <br />Vice Chair Kociscak called the public hearing to order at 7:15 p.m. <br /> <br />Presentation <br /> <br />Principal Planner Trudgeon stated that Royal Oaks Realty has submitted an application to rezone <br />property located at the southwest comer of CSAH 5 (Nowthen Blvd.) and Dysprosium Street <br />from B-1 Business and R-1 Single Family Residential to R-1 Single Family Residential, R-3U <br />Residential, and Multiple Residential. The rezoning would allow the property to be subdivided <br />for 88 single-family lots, 91 townhome units and 82 senior apartment units. The property is <br />86.71 acres in size and is within the Metropolitan Urban Service Area (MUSA). The 2001 <br />Comprehensive Plan identifies this area as being High Density Residential along Dysprosium St., <br />Medium Density Residential along Nowthen Blvd. and Low Density Residential on the western <br />part of the property. He noted that the development property is adjacent to property that is zoned <br />R-1 Single Family Residential, with the exception of a parcel north of the development property <br />that is zoned R-3 Urban Residential, and a portion of the Flintwood Hills P.U.D. that is adjacent <br />to the southeast portion of the development property. The Lord of Life Church property lying on <br />the northeast side of Nowthen Blvd. is zoned B-1 Business and the Savannah Oaks Senior <br />Apartment Building on the eastern side of Dysprosium is zoned Multiple Residential. <br /> <br />Principal Planner Trudgeon summarized the history of the case, noting that Royal Oaks Realty <br />submitted an application in the spring of 2001 to rezone the development property to Planned <br />Unit Development (PUD).
