Absent: Commissioners Johnson and Sweet. <br /> <br />Commissioner Kociscak recused himself from consideration of Case #5. <br /> <br />Case tt5: <br /> <br />Request for Sketch Plan Review of the Kociscak Minor Subdivision; Case of <br />Andrew Kociscak <br /> <br />Principal Planner Trudgeon stated that the City received an application from Andrew Kociscak <br />requesting a minor subdivision in order to create two lots from a 45-acre parcel. Mr. Kociscak is <br />proposing to split land from the Gilbert Menkveld Land Trust located north of County Highway <br />116 and west of Ramsey Blvd. Mr. Kociscak is in the process of purchasing 43.72 acres from <br />the Menkveld Trust. The minor subdivision is proposing to consist of two lots, 43.72 acres and <br />1.3 acres. The minor subdivision is proposing to consist of two lots, 43.72 acres and 1.3 acres. <br />Mr. Kociscak is planning to sell the 43 acres of land to Brightkeys Development Inc. Brightkeys <br />is planning to subdivide the parcel into a townhouse development at a future date. This minor <br />subdivision is necessary for Mr. Kociscak and Brightkeys to assemble the land and start the <br />development process. The property contains no structures and does not propose to construct any <br />roads at this time. The sketch plan as shown meets all dimensional requirements under City <br />Code. The land is currently zoned R-2, which allows for townhomes up to a density of 7 units <br />per acre. As this minor subdivision will be setting the stage for furore development, staff is <br />proposing to defer park and trail fees as well as sewer, water, and stormwater trunk fees at this <br />time. It is proposed that these fees will be collected at the time of future resubdivision. City <br />Staff recommends approval of the sketch plan contingent upon compliance with City Staff <br />Review letter dated July 3, 2002. <br /> <br />Chairperson Nixt asked about the necessity of carving off one lot. <br /> <br />Bill Hughes of Integrated Real Estate Services, Inc. and representing the applicant stated it is <br />required because when Mr. Kociscak bought the property from the Gilbert Menkveld Land Trust, <br />the lot was potentially being sold to a Casey's, but that request was denied. Meanwhile, the rest <br />of the property was sold to Mr. Kociscak and an unrecorded deed was given back to Menkveld. <br />That resulted in their inability to get a clear title to Brightkeys.
