I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />TO: <br /> <br />FROM: <br /> <br />RE: <br /> <br />DATE: <br /> <br />Ramsey City Council <br /> <br />City Attorney William Goodrich <br /> <br />Activity Report <br /> <br />May 25, 1982 <br /> <br />1) The 1982 Minnesota State Legislature adopted legislation creating a gross <br />misdemeanor for any one receiving a second DWI ticket within five years and a <br />third DWI in a ten year period. The legislature also directed that all such <br />gross misdemeanor charges be prosecuted by the local City Attorney. Therefore <br />we are now prosecuting those type of cases. In addition, we are now prosecuting <br />aggravated DWI charges which are gross misdemeanors. These are the charges <br />which arise when an individual is charged with DWI while having his driving <br />privileges suspended or revoked for a previous DWI. Both of these gross mis- <br />demeanors carry a maximum fine of $1,000 and a one year term in jail. While at <br />this time we have little experience to speak from, it does appear that this new <br />responsibility will increase, and perhaps significantly the amount of time my <br />office is involved in prosecution matters. The City Attorneys through~ut the <br />County are trying to encourage the County's judges to impose higher monetary <br />fines on the guilty defendants in order to help defray some of this added pro- <br />secution expenses. <br /> <br />2) The Council will recall that about a year and a half ago I advised you of <br />new legislation which was enacted permitting the Cities and Counties to sue <br />civilly road weight restriction violations. Based on Highway Patrol tickets, <br />we have now sued on behalf of the City the following companies: <br /> <br />N.D.H., Inc. <br />Frantim, Inc. <br />Oak Hill Trucking <br />Morrell Trucking, Inc. <br />Oman Construction <br />Thistle Construction Co. <br /> <br />The suits range from approximately $1,200 to $4,000. <br /> <br />3) There has been little progress on the landfill matter since your last regular <br />Council meeting. The County is attempting to get a handle on the amount of land <br />needed, the buffer zone, etc., and is trying to find out the cost of this project. <br />When the information has been ascertained we will then all at least know the mag- <br />nitude of the project. I will keep the Council advised as this progresses. <br /> <br />4) I will present at the meeting a proposed agreement with the City and Mr. Westphal <br />relating to the lots she would like subdivided. <br /> <br />WKG: po <br /> <br /> <br />
