m <br />m <br /> <br />THIRD AMENDED <br />PERFORMANCE CONTRACT WITH <br /> THE CITY OF RAMSEY <br /> <br />THIS AGREEMENT, made and entered into this 27th day of April, 1982 by and <br /> <br />i <br />I <br />I <br /> <br />between the City of Ramsey, located in Anoka County, State of Minnesota~ hereinafter <br />referred to as the "City", and Barthel Homes, Inc., having its principal place of <br />business at 21370 John Milless Drive, Rogers, Minnesota 55374, hereinafter referred <br />to as the "Developer~. <br /> <br /> I. <br /> <br />I WHEREAS, the parties hereto have previously entered into a Performance Contract <br /> <br /> relating to the development of the plat known as "Barthel's Rum River Acres 2nd <br />I Addition", said Contract being dated October 12, 1979, and <br /> <br /> II. <br /> <br />WHEREAS, the parties hereto have amended the said Performance Contract by an <br /> <br />I Amended Performance Contract dated October 8, 1980, and <br /> III. <br />I WHEREAS, the parties hereto have amended the said Performance Contract by an <br /> <br />i Amended Performance Contract dated October 11, 1981, and <br /> IV. <br /> <br />I WHEREAS, the Developer has now applied to the City to extend for two (2) years <br /> <br /> the completion date of the blacktop improvements for Phase I as described in <br />I Paragraph 1) of the Amended Performance Contract dated October 11, 1981, and <br /> <br />I <br />m1984, <br /> <br /> WHEREAS, the Developer has now applied to the City to extend until October 15, <br /> <br /> the completion date of the blacktop improvements for Phase II as described in <br />Paragraph 2) of the October 1I, 1981 Contract, and <br /> <br /> <br />
