Background information: I'm enclosing the following en- <br />closures for your information and review of the problem: <br /> <br />(a) Enclosure (1) Minutes of Public Hearing dated ~%y 1[ <br />1978. <br />(b) Enclosure (2) Minutes of City Council dated June 26, <br />1978. <br />(c) Enclosure (3) Copy of restrictive covenant which was <br />prepared in September, 1978. <br /> <br />Fact: The restrictive covenant and plat are to be addressed <br />as one document when going through final plat approval. Con-~ <br />sequently, it appears that was not a restrictive covenant <br />document before the Planning Commission at the public hear- <br />ing or when you took your action on the subject plat. <br /> <br />CASE 2: <br /> <br />Action: Council has referred it back to the Planning and <br />Zoning to review enclosure (3) in accordance with the petition <br />amendment to the zoning and subdivision ordinance regarding <br />accessory buildings and their uses. <br /> <br />REZONING FROMR-1 TO B-1 IN THE TRANSITIONAL AREA REGARDING <br /> <br />PROPOSED DENTAL CLINIC; CASE OF DR. ANDERSON: <br /> <br />Problem: The Council at their regular meeting on September 11, <br />1978, did not take any action on the above request because your <br />recommendation of approval for the rezonlng did not address <br />the City's Comprehensive Plan as to the effect it would have <br />on the City's master physical planning plan if granted. <br /> <br />Consequently, the Council has referred Dr. Anderson's request <br />for rezoning back-to Planning.-and Zoning Commission and have <br />requested that your report to them address the effect if any <br />it will have on the City's Comprehensive Plan. <br /> <br />Background'Information: I'm enclosing the following enclosures <br />for your information and review of the problem: <br /> <br />(a) Enclosure (4) your minutes dated August 21, 1978 which <br />contained your recommendation to the Council <br />(b) Enclosure (5) ~inutes of the public hearing dated <br />August 21, 1978. <br />(c) Enclosure (6) minutes of the Council meeting dated <br />August 21, 1978. <br /> <br />Comment: If the above request for rezoning is granted then <br />a special zoning district should be established to control <br />zoning in that area. <br /> <br />CASE 3: CONDITIONAL USE PERMIT; CASE OF FAITH BAPTIST CHURCH: <br /> <br />The Planning and Zoning Commission witl be guided by para- <br />graphs 170.016A through 170.016F in the action they will be <br />taking on this matter. <br /> <br /> <br />
