The public hearing closed at 9:48 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 9:48 <br />p.m. <br /> <br />Chairperson Nixt stated they had two cases tonight that dealt with the height of accessory <br />structures within the metropolitan services area. One parcel was less than and an acre and the <br />other was greater than one acre in size. He stated these issues should be regulated by parcel size <br />rather than whether or not a parcel is in or out of the MUSA. <br /> <br />Chairperson Nixt stated his recommendation is they should modify subdivision 5A and 5B to <br />basically use the one-acre threshold for height restrictions rather than the MUSA line. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to recommend that City <br />Council adopt an ordinance to amend the performance standards for accessory structures so that <br />the 16 foot height restriction will apply to parcels less than one acre in size and 22 feet will apply <br />to parcels greater than 1 acre in size; and parcels 2.5 acres and greater in size are exempt from the <br />requirement that restricts accessory structures to side and rear yards. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Johnson, Reeve, and <br />Watson. Voting No: None. Absent: Commissioner Brauer. <br /> <br />PLANNING COMMISSION BUSINESS <br /> <br />Case #7: <br /> <br />Request for an Extension of a Conditional Use Permit to Construct and <br />Operate a Cellular Antenna on a City Water Tower; Case of Verizon <br />Wireless <br /> <br />Community Development Director Frolik explained that on October 9, 2001, the City issued a <br />conditional use permit to Verizon Wireless to construct and operate a cellular antenna on the City <br />water tower located off of Sunwood Drive in the AEC Energy Park. Verizon Wireless has not <br />initiated their conditional use permit to construct and operate cellular antennas on the City's <br />water tower. On July 26, 2002, the City received a written request from Jim Nelson, authorized <br />agent for Verizon Wireless, requesting an extension to initiate the conditional use permit. The <br />stated reason for the delay in initiating the construction of the equipment is due to lengthy <br />negotiations between the City Attorney and Verizon Wireless regarding language in the lease <br />agreement. City Staff is recommending approval of the request for conditional use permit <br />extension. <br /> <br />Chairperson Nixt stated he has to recuse himself so he cannot vote. <br /> <br />Planning Commission/August 29, 2002 <br /> Page 15 of 18 <br /> <br /> <br />
