Motion by Commissioner Kociscak, seconded by Commissioner Reeve, to approve the following <br />minutes as presented: <br /> <br />1) Planning Commission public hearing and regular meeting minutes dated July 11, 2002. <br /> <br />Motion Carried. Absent: Commissioner Brauer. <br /> <br />NOTE CITY COUNCIL MINUTES <br /> <br />The following Council minutes were noted: <br /> <br />1) City Council regular meeting minutes dated June 25, 2002 <br />2) City Council regular meeting minutes dated July 9, 2002 <br />3) City Council regular meeting minutes dated July 23, 2002 <br /> <br />PLANNING COMMISSION BUSINESS <br /> <br />Case#l: Request for Site Plan Review of a Gas/Convenience Facility; Case of <br /> Fariborz Yamoutpour <br /> <br />Community Development Director Frolik explained that Frank Yamoutpour is proposing to <br />develop a convenience store with gasoline pumps, a car wash, and a fast food facility on Lot 2, <br />Block 1, Sunfish Commons, located at the comer of Sunfish Lake Boulevard (County Road 57) <br />and U.S. Highway 10. The proposed building exceeds the required front, rear and side yard <br />setbacks established in the B-3 Business District. In accordance with City Code all driveways, <br />off-street parking and maneuvering areas are proposed to be surfaced with bituminous pavement <br />and finished with B-6/12 concrete curbing. The site plan complies with the minimum parking <br />requirements established in City Code. The structure will be constructed with a stucco and brick <br />finish; this complies with City Code. City Code requires a 20-foot landscape area adjacent to all <br />public streets. Earlier this evening the Board of Adjustment denied the Applicant's request for a <br />variance to the landscape requirement adjacent to Sunfish Lake Boulevard. <br /> <br />Commissioner Johnson asked the project architect, Mr. Ovick, if the Applicant would prefer that <br />the request for site plan review be tabled at the Planning Commission level based on the denial of <br />the variance. <br /> <br />Mr. Ovick stated the Applicants wanted to start construction this Fall and if tabled at the <br />Planning Commission level, it would kill the project. <br /> <br />Commissioner Johnson stated the Commission might want to make a recommendation on the site <br />plan and allow the Applicant to proceed to City Council for the final decision. <br /> <br />Planning Commission/August 29, 2002 <br /> Page 2 of 18 <br /> <br /> <br />
