City Atlorney Goodrich replied a bank attorney is reviewing that. It cannot be requested at this <br />time because of the bank petition, and the bankruptcy has not been discharged. Perhaps the new <br />company will be willing to do this, but they would not be obligated. <br /> <br />Councihnember Elvig stated this may be an opportunity.for the City to push its hand on this <br />issue. Ne asked if it could be suggested that the City is in acceptance of this, but all liabilities to <br />the City should be paid also. <br /> <br />City Attorney Goodrich explained this agreement will pay the City back; it is not a benefit to <br />Vision-Ease or the new entity. <br /> <br />Mayor Gamcc stated the TIF investment is far more important than the money from the utilities. <br /> <br />Counci hnember Elvig requested the collection of this payment be attempted. <br /> <br />Counci hnember Cook suggested the collection be attempted after this agreement is approved. <br /> <br />City Attorney Goodrich indicated the City has received some correspondence from the company <br />purchasing Vision-Ease and they seem cordial and happy to come to Ramsey. Perhaps this <br />would be an avenue for communication. <br /> <br />Motion by Councihnember Elvig, seconded by Councilmember Cook, to direct staff to enter into <br />an assumption agreement to transfer Development Agreement from Vision-Ease Lens, h~c. to <br />Insight Equity A.P.X, LP, a Texas Limited Partnership. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Kurak, Pearson, <br />Strommcn, and Zimmmrnan. Voting No: None. <br /> <br />Case #10: <br /> <br />Refer Citizen Petition Concerning Speed Limit on Baugh Street to Anoka <br />County Public Works Committee for Consideration <br /> <br />Assistant Public Works Director Olson indicated last week the City received a petition from <br />residents along Baugh Street requesting that the speed limit be reduced to 35 mph from 55 mph. <br />There was a lot of discussion at the Public Works Committee and they felt it would be best to try <br />to process this petition as quickly as possible, rather than waiting for the report of the Public <br />Works Committee. The recommendation of the Public Works Committee was to forward the <br />petition on to the Anoka County Public Works Committee for consideration at the earliest <br />possible opportunity. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Zimmerman, to adopt Resolution <br />#04-09-303 requesting that the Anoka County Public Works Committee consider the citizen <br />petition requesting the lowering of the speed limit on the subject segment of CR83 at the earliest <br />possible opportunity. <br /> <br />City Council/September 28, 2004 <br /> Page 13 of 17 <br /> <br /> <br />
