35.2 Before commencing Work under this Agreement, the Contractor shall furnish the Owner with <br />certificates of insurance specified herein showing the type, amount, class of operations covered, <br />effective dates, and date of expiration of policies, and containing substantially the following statement: <br /> <br /> "The insurance covered by this certificate will not be cancelled or materially altered, except <br />after 10 days written notice has been received by the Owner." <br /> <br />35.3 In case of the breach of any provision of this Article, the Owner, at his option, may take out and <br />maintain, at the expense of the Contractor, such insurance as the Owner may deem proper and may <br />deduct the cost of such insurance from any monies which may be due or become due the Contractor <br />under this Agreement. <br /> <br />ARTICLE 36. Contractor and Subcontractor Insurance <br /> <br />The Contractor shall not commence Work on this Agreement until he has obtained all the insurance <br />and it has been reviewed by the Owner, nor shall the Contractor allow any Subcontractor to commence <br />Work on his subcontract until all similar insurance required for that portion of the Work has been so <br />obtained and reviewed. Review of the insurance by the Owner shall not relieve or decrease the liability <br />of the Contractor hereunder. <br /> <br /> <br />ARTICLE 37. Compensation and Employer's Liability Insurance <br /> <br />The Contractor shall maintain during the life of this Agreement the statutory Worker's Compensation, <br />in addition to, Employer's Liability Insurance in an amount not less than $100,000 for each occurrence <br />and a combined single limit of liability of $1,000,000 for each occurrence for all of his employees to <br />be engaged in Work on the Project under this Agreement and, in case any such Work is sublet, the <br />Contractor shall require the Subcontractor similarly to provide Worker's Compensation and Employer's <br />Liability Insurance for all of the latter's employees to be engaged in such Work. Where Work under <br />this Agreement includes any water or navigational exposure, coverage shall be included to cover the <br />Federal Longshoremen's and Harborworker's Act and the Federal Jones Act. <br /> <br />ARTICLE 38. Public Liability (including Automotive) and Property Damage Insurance <br /> <br />38.1 The Contractor shall maintain during the life of this Agreement such public liability and <br />property damage insurance and automobile public liability and property damage insurance and shall <br />protect him, the Owner, the Engineer, and any Subcontractor performing Work covered by this <br />Agreement from claims for damages for personal injury, including accidental death, as well as from <br />claims for property damage, which may arise from negligent operations under this Agreement, whether <br />such operations are by himself or by any Subcontractor or by anyone directly or indirectly employed <br />by either of them, and the amounts of such insurance shall be not less than: <br /> <br />(1) Public liability insurance in an amount not less than $500,000 for injuries, including wrongful <br />death to any one person, and subject to the same limit for each person in an amount not less than <br />$1,000,000 for each occurrence. <br /> <br />GC 24 <br /> <br /> <br />
