(2) "Broad Form" property damage liability insurance in an amount not less than $500,000 for each <br />occurrence. <br /> <br />38.2 The Contractor's public liability insurance and property damage insurance shall provide the <br />primary coverage on all claims arising out of the performance of the Agreement, and shall name the <br />Owner, its officers, agents and employees, and the Engineer as additional insureds therein. <br /> <br />ARTICLE 39. Builders Risk All Risk Insurance <br /> <br />Unless otherwise modified in the Special Provisions, the Contractor shall secure and maintain during <br />the life of this Agreement, Builders Risk All Risk Insurance coverage for 100 percent of the Contract <br />Price. Such insurance shall not exclude coverage for earthquake, landslide, flood, collapse, or loss due <br />to the results of faulty workmanship, and shall provide for losses to be paid to the Contractor and the <br />Owner as their interest may appear. <br /> <br />ARTICLE 40. Insurance Coverage for Special Conditions <br /> <br />When the construction is to be accomplished within a public or private right-of-way requiring insurance <br />coverage, the Contractor shall conform to the particular requirements and provide the required <br />insurance. The Contractor shall include in his liability policy all endorsements that the said authority <br />may require for the protection of the authority, its officers, agents and employees. Insurance coverage <br />for special conditions, when required, shall be provided as set forth in the Special Provisions. <br /> <br />ARTICLE 41. Cleaning Up <br /> <br />The Contractor will keep the premises free from accumulations of waste materials, rubbish and other <br />debris resulting from the Work, and at the completion of the Work he will remove all waste materials, <br />rubbish and debris from and about the premises and will remove all items of personal property such as <br />all tools, construction equipment and machinery, and surplus materials, and further will leave the site <br />broom-clean and ready for occupancy by the Owner. The Contractor will restore to the original <br />condition those portions of the Work site not designated for alteration by the Contract Documents. <br /> <br />ARTICLE 42. Owner's Right to Stop or Suspend Work <br /> <br />42.1 If the Work is defective, or the Contractor fails to supply sufficiently skilled workmen or <br />suitable materials or equipment, or if the Contractor fails to make prompt payments to Subcontractors, <br />or for labor, materials or equipment, the Owner may order the Contractor to stop the Work, or any <br />portion thereof, until the cause for such order has been eliminated. <br /> <br />42.2 The Owner may, at any time and without cause, suspend the Work or any portion thereof, for a <br />period of not more than one hundred eighty (180) days by notice in writing to the Contractor and the <br />Engineer which shall fix the date on which Work shall be resumed. The Contractor will resume the <br />Work on the date so fixed. <br /> <br />ARTICLE 43. Owner's Right to Terminate <br /> <br />GC 25 <br /> <br /> <br />
