set~'ices. Brightkeys thought they were making a good move for the neighbors with a less
intense use. ll:'this is objectionable to someone they can make changes to the plan.

Chairperson Nixt asked what other deviations there are from the last proposed development other
than the changes Mr. Dommer just described.

Mr. Dommer replied the other deviations would be in the southwest comer. They have changed
the building type there to be more consistent with the Town Center character. He stated they are
complete, iy surrounded by Town Center and have bought into the Town Center concept. These
buildings have been changed to be more Georgetown. The 'back to back townhomes' are still
there, but have been moved further north.

Commissioner Brauer questioned why the developer is bringing the Commission a sketch plan
with the intent to rezone it in the future so the sketch plan matches with the zoning, rather than
rezoning the property before the sketch plan is submitted. He stated he cannot approve this plan
under the existing zoning because it does not fit.

Assistant Community Development Director Trudgeon explained the sketch plan was submitted
based on staff' direction to get a t'eeling if something like this would be approve& for the zoning
in the iS~ture. [f this is not appropriate they should hear that tonight. Commissioner Brauer is
correct that this plan would not be allowed under the current zoning. Staff would like input as to
whether the Commission would be inclined to grant sketch plan approval contingent on rezoning,
a comprehensive plan amendment, etc. If that is not appropriate they would like direction as to
what is not appropriate about the plan. If it is loud and clear this plan will not work that message
should be delivered.

Chairperson Nixt questioned if this plan still follows the preliminary plat that was approved.

Assistant Community Development Director Trudgeon reviewed the area that was approved in
the preliminary plat in 2002. He explained the other areas were shown as outlots. Brightkeys is
requesting input t'rom the Commission of the cun'ent sketch plan if there were to be changes in
the zoning.

Commissioner Brauer stated he would expect a sketch plan that meets the law, Which this plan
does not do. It is almost a waste of his time to look at a sketch plan that does not meet the law.
If Brightkeys wants to change the zoning that change should be brought forward and a sketch
plan should then be submitted that matches the zoning.

Mr. Dommer indicated Brightkeys will withdraw this application and bring back the rezoning
unless ~he Commission can give him a good reason not to.

Chairperson Nixt reviewed the following deficiencies with the proposed sketch plan:
1. The substitution of a well aesthetically designed dwelling unit is not a substitute for
density' transition.
2. The proposed site plan exceeds the cmTent density and he is not inclined to agree that this
area should be zoned the same as Town Center at its maximum density.

30

Planning Commission/August 5, 2004
