Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #04-11- A RESOLUTION ADOPTING FINDINGS OFFACT #0 RELATING TO A REQUEST FOR AN AMENDMENT TO CONDITIONAL USE PERMIT TO CONSTRUCT A BUILDING LARGER THAN 35,000 SQURE FEET IN THE TC-2 ZONING DISTRICT WHEREAS, Ramdance, LLC, hereinafter referred to as tt{e "Applicant," has properly applied fl0r an amendment to Conditional Use Permit (CUP) to construct a building larger than 35,000 square feet in the TC-2 Zoning District on property legally described as follows: Outlot [, Ramsey Town Center Addition, Anoka County, Minnesota CS ubject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOtC4 COUNTY, STATE OF MINNESOTA that the findings Of fact relating to the request are determined to be as follows: 1. That the kamsey City Council adopted the Town Center Zoning District on September 23, 2003. 2. That the Subject Property is zoned TC-2 and is located inside the metropolitan urban service area. (MUSA). 3. That the TC-2 Zoning District states that buildings, larger than 35,000 square feet are only permitted as a conditional use within the District. That in June, 2004, the Applicant submitted an application for a Conditional Use Permit to construct a 54,000 square-foot ~ocery store within the Ramsey Town Center development; with plans for future expansions up to 63,000 square feet. 5. That on July 27, 2004, the Ramsey City Council issued a CUP to the Applicant for the development of up to a 63,000 Square foot grocery store on the Subject Property-. · That i.n August, 2004, the Applicant submitted a final site plan for the development of the Subject Property that indicated the initial size of the grocery store would be 62,000 square feet versus the ~brmer proposal of 54,000 square feet. 7. That thc 8,000 square toot increase to the size of the grocery building is in conformance with the CUP issued by the City on July 27, 2004. 5
