Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-11- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF-A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br /> WHEREAS, TSM Development, Inc., hereinafter referred to as "Permittee,;' has <br />properly applied for a variance from Section 9.20.24 regarding pavement setbacks from public <br />street right-of-way in the E-1 Employment District on the property, generally located on Ramsey <br />Blvd and Bunker Lake Blvd and legally described as follows: <br /> <br />Outlot A, Regency Pond, Anoka County, Minnesota <br /> <br />(the :'S ubj ect Property") <br /> <br /> WHEREAS, the Board of Adjustment met on November 4, 2004, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from pavement <br />setbacks from public street right-of-way. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />Based on Findings of Fact #__, a variance is hereby granted to the pavement setback <br />fi'om public street right-of-way, as eStablished in Section 9.20.24 of the Ramsey City <br />Code, to install a bituminous surface and concrete curb up to zero (0) feet of the property <br />line acijacent to the new cul de sac to be constructed at the terminus of 148a Ave NW. <br /> <br />The Permittee shall construct the cul de sac and other improvements per the approved <br />Site Plan and plat of Regency Pond 4th Addition and to the City's specifications. <br /> <br />The Perlnittee shall be responsible for all City costs incurred in processing the variance <br />request. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Shepherd, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />anct the ~bllowing abstained: <br /> <br />and the l;bllowing were absent: <br /> <br />Whereupon said resolution was declared duly adopted by the Ramsey Board' of Adjustment this <br />the 4t~ day ol;' .November. 2004. <br /> <br />t5 <br /> <br /> <br />
