Board Member introduced the following resolution and moved for its adoption: RESOLUTION #04-11- A RESOLUTION APPROVING THE ISSUANCE OF-A VARIANCE AND DECLARING TERMS OF SAME. WHEREAS, TSM Development, Inc., hereinafter referred to as "Permittee,;' has properly applied for a variance from Section 9.20.24 regarding pavement setbacks from public street right-of-way in the E-1 Employment District on the property, generally located on Ramsey Blvd and Bunker Lake Blvd and legally described as follows: Outlot A, Regency Pond, Anoka County, Minnesota (the :'S ubj ect Property") WHEREAS, the Board of Adjustment met on November 4, 2004, conducted the public hearing and adopted findings of fact relating to the request for a variance from pavement setbacks from public street right-of-way. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows Based on Findings of Fact #__, a variance is hereby granted to the pavement setback fi'om public street right-of-way, as eStablished in Section 9.20.24 of the Ramsey City Code, to install a bituminous surface and concrete curb up to zero (0) feet of the property line acijacent to the new cul de sac to be constructed at the terminus of 148a Ave NW. The Permittee shall construct the cul de sac and other improvements per the approved Site Plan and plat of Regency Pond 4th Addition and to the City's specifications. The Perlnittee shall be responsible for all City costs incurred in processing the variance request.
