Board Member introduced the following resolution and moved fbr its adoption: RESOLUTION #04-11- A RESOLUTION APPROVING THE ISSUANCE OF.A VARIANCE AND DECLARING TERNIS OF SAME. WHEREAS, TSM Development, Inc., hereinafter, referred to as "Permittee," has properly applied tbr a variance from Section 9.20.24 regarding bufferyard requirements in the E- l Emptoyment District on the property generally located on Ramsey Bird and Bunker Lake Bird and legally described as follows' Outlot A, Regency Pond, Anoka County, Minnesota (the :'S ubj ect Property") WHEREAS, the Board of Adjustment met on November 4, 2004, conducted the public hearing and adopted findings of fact relating to the request for a variance from buf£eryard requirements in the E-1 Employment District. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUST~ lENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows 'Based on Findings of Fact # , a variance is hereby granted to the 60-foot bufferyard requirement, as established in Section 9.20.24 of the Ramsey City Code, to allow a 30- tbot bufferyard to be constructed along the northern property line of Outlot A, Regency Poad. The Permittee shall construct the bufferyard and other improvements per the approved Site Plan and plat of Re'gency Pond 4ta Addition and to the City's specifications. The Permfftee shall be responsible for all City costs incurred in processing the variance request. The motion for the adoption of the foregoing resolution was duly seconded by Board Member Shepherd, and upon vote being taken thereon, the following voted in favor thereof: and the rbllowing voted against the same: and the ~bllowing abstained: and the fi>llowing were absent: Whereupon said resolution was declared duly adopted by the Ramsey Board o(' Adjustment this the 4tt~ day o/f November, 2{)04.
