CITY OF RA~.ASEY <br /> CITY COUNCIL <br />FINDINGS OF FACT re Thomas Johnstone <br /> CONDITIONAL USE PERMIT <br /> <br />l) <br /> <br />That the applicant has properly applied for a conditional use permit <br />as req~ired by City Ordinance to maintain a private kennel. <br /> <br />That the applicant appeared before the Planning and Zoning Commission <br />for a public hearing pursuant to the City Zoning ordinance on March 3, <br />1980. That said public hearing was properly advertized and the minutes <br />of that public hearing are hereby incorporated by reference, <br /> <br />3) That the Standards for Consideration are as follows: <br /> <br />a) The property is zoned R-1 and this is not a permitted use, <br /> <br />b) The adjoining properties are residential dwellings located on <br /> approximately four acre wooded parcels on all sides. <br /> <br />c) The closest similar use is approximately one (1) mile which is a <br /> co~nercial kennel. <br /> <br />d) There will be no change in traffic flow to the area. <br /> <br />e) <br /> <br />There are three (3) tn~own kennels in operation in'the City which <br />to our knowledge have not caused neighborhood problems. However, <br />'there are nmmerous individuals that should have conditional use <br />permits for private kennels that do cause problems because of a <br />lack of proper facilities to control animals. <br /> <br />f) <br /> <br />Properly maintained, the keznnel will not affect the life style <br />of the neighboring residents in a rural setting. Further~ it <br />should not affect the enjoyment or value of properties in the <br />vicinity. <br /> <br />4) That the Criteria for ~pproval/Disapproval are as follows: <br /> <br />The applicants request for four (4) adult dogs, two Irish Setters <br />and two Cocker Spaniels, which the applicant slates are to be bred <br />every other year and which litters shall not exceed four (4) months <br />of age, and properly maintained should not be detrimental to or <br />endanger the public health, safety or general welfare and is not <br />contrary to established standards as regulated by City Codes. <br /> <br />b) <br /> <br />The applicants proposed kennel area has been reviewed by a licensed <br />Doctor of Veterinary Medicine and said letter is hereby incorporated <br />as a part of these findings by reference hereof. <br /> <br /> <br />
