for many years. Each of them made reference to the potential future development of their own <br />property. Mr. Peterson stated he does not understand the new density ordinance and finds it <br />confusing. He stated that a 300-foot buffer is referenced in the ordinance which does not make <br />sense to him since it renders that property undevelopable. Mr. Peterson distributed colored <br />pictures of several of the lots in the proposed addition depicting tall Norway Pines (about 30 feet <br />tall) and lower vegetation on the common property line with the parcels to the west. <br /> <br />Chairperson Nixt asked if he would be willing to sign a tree preservation plan that would restrict <br />those trees from being removed. <br /> <br />Mr. Peterson stated they would and also bind the future homeowner from destroying the trees. <br />He then continued his review of the colored pictures and emphasized that these existing trees <br />provide a natural screen that is far superior to anything they could have provided. <br /> <br />Chairperson Nixt asked how much site grading would have to be done. <br /> <br />Mr. Peterson stated a street will be installed but these trees will not be removed from the <br />proposed lots. <br /> <br />Chairperson Nixt stated he would be willing to allow Mr. Peterson to work with staff on that <br />resolution. He stated he believes that the Planning Commission needs to take the position that <br />the Density Transition Ordinance applies and go through the process to interpret the ordinance <br />and determine what provisions would apply. He noted that since a buffer and screen already <br />exist, the Planning Commission may be able to grant the petitioner relief from application of the <br />ordinance. He stated the applicant has done a good job of presenting his case on why relief <br />should be granted from the ordinance. He stated he would like the preliminary plat to delineate <br />these trees so it can be determined if any will be impacted by placement of the roads. <br /> <br />Motion by Commissioner Johnson, seconded by Chairperson Nixt, to approve the sketch plan <br />contingent upon compliance with the City Staff Review Letter dated September 26, 2002, <br />approval of an acceptable tree preservation plan, and delineating the trees on the preliminary plat. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Kociscak, and Reeve. <br />Voting No: None.
