Further discussion: Chairperson Nixt stated that findings one and two are fine and he would like <br />to have a finding inserted, if not already in there, that the Architectural Review Committee on <br />two separate occasions has denied the request of the applicant. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Brauer, and Reeve. <br />Voting No: None. Absent: Commissioners Johnson and Watson. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to recommend that City <br />Council deny David and Sandra Shappell's request to exceed accessory building size restrictions <br />based on the findings of fact, and adopt a resolution declaring terms of same. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Brauer, and Reeve. <br />Voting No: None. Absent: Commissioner Johnson and Watson. <br /> <br />Case #3: <br /> <br />Request for Sketch Plan Approval for Mallard Ponds 2na Addition; Case of <br />Bulow, Inc. <br /> <br />Principal Planner Trudgeon stated that the City received an application from Bulow Inc. <br />requesting a minor subdivision in order to create one lot from two existing lots. Bulow Inc. <br />would like to develop a 6,000 square foot multi-tenant office building on the new lot. The minor <br />subdivision would combine Lot 97, Block 1 and Outlot A of the Mallard Ponds subdivision. <br />The new lot is proposed to be 0.94 acres in size. Lot 97, Block 1 is a vacant lot and was <br />designated for a commercial lot as part of the Mallard Ponds P.U.D. Oultot A is owned by <br />Bulow Inc. and is a ten-foot wide lot around the perimeter of the Mallard Ponds subdivision. It <br />currently contains an eight-foot wide bituminous trail. Once the two lots are combined, the <br />applicant will be required to provide a public access easement for the use of the trail to the City. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to approve the sketch plan <br />for Mallard Ponds 2nd Addition and recommend that the City Council grant final plat approval <br />contingent upon compliance with City Staff review letter dated September 27, 2002. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Brauer, and Reeve. <br />Voting No: None. Absent: Commissioners Johnson and Watson. <br /> <br />Case #4: <br /> <br />Request for Site Plan Review for Mallard Ponds Office Building; Case of <br />Bulow Inc. <br /> <br />Principal Planner Trudgeon explained that the City received an application from Bulow Inc. <br />proposing to construct a 6,000 square foot multi-tenant office building at the northeast comer of <br />Dysprosium St. and County Highway 116. The applicant is proposing to develop a one-story <br />multi-tenant office building consisting of 6,000 square feet. The site plan indicates the building <br />will be split into four 1500 square foot office spaces. The site is currently zoned Planned Unit <br />Development (PUD). The Development Agreement for the Mallard Ponds subdivision, which <br />this lot is part of, contained language that allowed the subject property to be developed as a <br /> <br />Planning Commission/October 10, 2002 <br /> Page 3 of 20 <br /> <br /> <br />
