Commissioner Nixt stated he understands Commissioner Kociscak's concern but if the property <br />owner wants the rezoning, they should give him that right. <br /> <br />Commissioner Reeve asked about the last sentence in the report stated "This property proposing <br />to be rezoned from B-1 Business to R-2 Medium Density Residential complies with the <br />Comprehensive Plan." He asked if the Comp. Plan states it will be R-2 all the way across. <br /> <br />Associate Planner Wald stated the Comprehensive Plan stated south of the platted outlot is zoned <br />medium density and north is designated for mixed use. She stated they have not rezoned the B-1 <br />to mixed use yet. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Reeve, to recommend that City <br />Council adopt Findings of Fact relating to a request from Turtle Moon Inc. to rezone property <br />from B- 1 Business to R-2 Residential with the findings of fact favorable. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Reeve, and Brauer. Voting No: <br />Commissioner Kociscak. Absent: Commissioners Johnson and Watson. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Brauer, to recommend that City <br />Council approve the request to rezone property, based on the Findings of Fact. <br /> <br />Motion Carried. Absent: Commissioner Johnson and Watson. <br /> <br />Case #8: <br /> <br />Request for Preliminary Plat of Rivenwick 3ra Addition; Case Turtle Moon, <br />Inc. <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:25 p.m. in <br />order to reopen the public hearing. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt reopened the public hearing at 8:25 p.m. <br /> <br />Presentation <br /> <br />Associate Planner Wald stated the City has received an application from Turtle Moon Inc. for <br />preliminary plat review of a townhome development. The property is generally located south of <br />Riverdale Drive and north of the existing Rivenwick urban residential development. The project <br />area is approximately 19.46 acres in size. The maximum net density established in the R-2 <br />District is 7 units per acre. The preliminary plat is proposing to development 112 townhouse <br />units. The development contains an MSA road and therefore net area for the project is 16 acres. <br />Net density for the proposed development is 7 units per acre; this complies with City Code.
