l) Board of Adjustment public hearing and regular meeting minutes dated September 2, 2004 <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Johnson, Board Members Brauer, Watson, <br />Jeffrey, and Shepherd. Voting No: None. Absent: Chairperson Nixt and Board Member Van <br />Scoy. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to Pavement Setback Requirements from Public <br />Street Right-of-Way; Case of Dan Druk, Druk Classic Auto <br /> <br />Acting Chairperson Johnson closed the regular portion of the Board of Adjustment meeting at <br />7:05 p.m. in order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Acting Chairperson Johnson called the public hearing to order at 7:05 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that Daniel Druk of Druk Classic Auto currently <br />leases a portion of George Cowles property at 9535 Highway #10 N.W. Mr. Druk is proposing <br />to pave the vehicle display and customer parking areas to bring the site into compliance with City <br />Code performance standards for the B-2 Highway Business District. However, the vehicle <br />display area and the customer parking area is limited because the building is located so close to <br />the front property line. If Mr. Druk complies with the 20 foot setback for pavement from public <br />right of way, he is left with a business operation area that is only 40 feet in depth. Therefore, he <br />has applied for a variance to install pavement approximately 2 feet from the fence, and the fence <br />is approximately 2 feet off the front property line. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Board Member Jeffrey, seconded by Board Member Brauer, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Johnson, Board Members Jeffrey, Brauer, <br />Shepherd, and Watson. Voting No: None. Absent: Chairperson Nixt and Board Member Van <br />Scoy. <br /> <br />The public hearing closed at 7:07 p.m. <br /> <br />Board Business <br /> <br />Board of Adjustment/October 7, 2004 <br /> Page 2 of 5 <br /> <br /> <br />
