Acting Chairperson Johnson called the Board of Adjustment meeting back to order at 7:07 p.m. <br /> <br />The consensus of the Planning Commission is that the pavement and curbing should maintain a 3 <br />foot separation from the fenceline to prevent damage to the fence by parking vehicles. <br /> <br />Motion by Board Member Brauer, seconded by Board Member Jeffrey, to adopt Resolution #04- <br />10-304 adopting Findings of Fact #0701 relating to a request for a variance to pavement setback <br />requirements from public street right-of-way at 9535 Highway #10 N.W. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Johnson, Board Members Brauer, Jeffrey, <br />Shepherd, and Watson. Voting No: None. Absent: Chairperson Nixt and Board Member Van <br />Scoy. <br /> <br />Motion by Board Member Brauer, seconded by Board Member Shepherd, to approve the request <br />for a variance to pavement setback requirements for the property located at 9535 Hwy 10 N.W., <br />contingent upon a paving plan approved by the City Engineer, and adopting Resolution #04-10- <br />305 declaring terms of same. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Johnson, Board Members Brauer, Shepherd, <br />Jeffrey, and Watson. Voting No: None. Absent: Chairperson Nixt and Board Member Van <br />Scoy. <br /> <br />Case #2: <br /> <br />Request for a Variance to Subdivision Design Standards Relating to Street <br />Frontage or Lot Width in the R-1 Residential Rural Developing District; <br />Case of John Rowe <br /> <br />Acting Chairperson Johnson closed the regular portion of the Board of Adjustment meeting at <br />7:10 p.m. in order to conduct the public hearing. <br /> <br />Public Hearin~ <br /> <br />Acting Chairperson Johnson called the public hearing to order at 7:10 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that the City has received an application for a <br />variance fi'om Section 9.50.30 (Subdivision Design Standards -Lots) of the Ramsey City Code. <br />Section 9.50.30 states that all lots shall have at least the minimum required frontage on a publicly <br />dedicated street. Section 9.20.11 establishes a minimum lot width or street frontage of 200 feet <br />in the R~I Rural Developing District. The property at 6530 Green Valley Road contains a <br />homestead and the Green Valley Greenhouse operations. The applicant is proposing to subdivide <br />the property so that the home and greenhouse will be on separate lots. In order to hold the size of <br />the lot with the home on it to the 2.5 acre minimum lot size, it requires a street frontage of only <br />100 feet as the house sits so far back on the property. <br /> <br />Board of Adjustment/October 7, 2004 <br /> Page 3 of 5 <br /> <br /> <br />
