SPECIAL PROVISIONS - SP20I6 BOOK <br />Last Revision by CO Special Provisions: 2/08/17 <br />Created August 20, 2015 <br />Page 17 <br />SP 0202-101 <br />S-14.1 If the Contractor operations involve the excavation and/or disposal of material off MnDOT Right of Way, <br />the Contractor is advised of the following: <br />MN Statutes Sections 103G.2212 and 103G.241 stipulate that an agent or employee of another <br />may not: <br />1) drain, excavate, or fill a wetland, wholly or partially; or <br />2) construct, reconstruct, remove, or make any change in any reservoir, dam, or the course, <br />current, or cross-section of any public water <br />unless a signed statement from the property owner is obtained stating that any permit or wetland <br />replacement plan required for the work is in place, or that a permit or replacement plan is not required; AND this <br />statement is mailed to the appropriate office with jurisdiction over the wetland or public water prior to initiating the <br />work. <br />The "Landowner Statement and Contractor Responsibility For Work in Wetlands or Public <br />Waters" can be found at http://www.bwsr.state.mn.us/wetlands/forms/Contractor_Responsibility.doc . The <br />Contractor shall provide the Engineer with a copy of the completed "Landowner Statement and Contractor <br />Responsibility for Work in Wetlands or Public Waters" for the excavation and/or disposal site prior to initiating the <br />work. <br />S-15 (1714) RESPONSIBILITY FOR DAMAGE CLAIMS <br />The provisions of 1714 are supplemented as follows: <br />The Contractor must have the State of Minnesota named as an additional insured on any insurance <br />coverage the contractor is required to provide. <br />S-16 (1716) CONTRACTORS RESPONSIBILITY FOR WORK <br />The provisions of 1716 are supplemented as follows: <br />All warranties provided by Contractor, for the work performed on the trunk highway, will flow to, <br />and be enforceable by, the State as the owner of such improvements. <br />S-17 (1717) NATIONAL POLLUTANT DISCHARGE ELIMINATION <br />SYSTEM (NPDES) PERMIT <br />REVISED 04/26/16 <br />Pollution of natural resources of air, land and water by operations under this Contract must be <br />prevented, controlled, and abated in accordance with the rules, regulations, and standards adopted and established by <br />the Minnesota Pollution Control Agency (M.P.C.A.), and in accordance with the provisions of MnDOT 1717, these <br />Special Provisions, and the following: <br />S-17.1 By signing the MPCA/NPDES Declaration and completing the electronic online NPDES CSW <br />permit, the Contractor is a co-permitee with the Department to ensure compliance with the terms and conditions of <br />the Construction General Storm Water Permit (MN R100001) and is responsible for those portions of the permit <br />where the operator is referenced. This Permit establishes conditions for discharging storm water to waters of the <br />State from construction activities that disturb 1 acre [0.4 hectares] or more of total land area. A copy of the permit is <br />available at http://www.pca.state.mn.us/water/stormwater/stormwater-c.html or by calling 651-296-3890. <br />(B) The Department will apply and pay for the MPCA/NPDES General Construction Stormwater <br />Permit as Owner and Contractor on this project. The Department will provide the Contractor with the Notice of <br />Termination/Permit Modification Form with the Existing Permit Identification, Option 2, Current Owners <br />Authorization Signature, and Current Contractor Authorization signature completed, as part of the Contract <br />
