Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #04-11-XXX <br />A RESOLUTON ACCEPTING CHANGE ORDER #4 TO IMPROVEMENT PROJECT <br />#03-29, MSA STREETS IN RAMSEY TOWN CENTER <br />WHEREAS, the City Council has awarded the contract for Improvement Project #03-29 <br />to Glenn Rehbein Companies, and <br />WHEREAS, the work includes installation of Storm Sewer pipe and structures which <br />connect to regional the storm sewer system installed by the developer, and <br />WHEREAS, the developer has requested and received approval to modify the regional <br />system to improve the marketability of certain lots, and <br />WHEREAS, the regional storm sewer system improvements require changes to Storm <br />sewer covered under this project, and <br />WHEREAS, these changes do not enhance the function of the MSA roads constructed <br />under this contract, and <br />WHEREAS, the developer RTC LLC has submitted a letter agreeing to reimburse the <br />city for the cost of said improvements. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) Change order # 4 to Improvement Project 03-29 is accepted in the amount of $79,083.31. <br />2) Payment from RTC LLC will be received and credited to this change order. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />Whereupon said resolution was declared duly passed and adopted by the Ramsey City Council <br />this the 9"' day of November 2004. <br />ATTEST: <br />City Clerk <br />Mayor <br />RESOLUTION #04-11-XXX <br />Page 1 of 1 <br />
