As stated above, City Code requires a 20-foot landscaped buffer area adjacent to all public <br />streets. The site plan is proposing to provide a total of 2.6 feet of green space area along Sunfish <br />Lake Blvd. The proposed green space area is serving as the mi.nimum buffer needed to meet <br />bicycle design standards and does not meet the intention of City Code to provide a landscape area <br />adjacent to all public streets. <br /> <br />The Applicant is requesting the landscape area requirement be waived for the subject property <br />based on the desire to meet the U.S. Dept of Transportation's turning radii recommendation. The <br />Applicant has stated that the need to deviate from the 20-foot landscape requirement will give <br />customers the minimum maneuvering area required for a safe and comfortable access to the <br />proposed convenience and fast food facility. <br /> <br />Recommendation: <br /> <br />Due to design concerns being addressed as part of site plan review for the convenience gas, fast <br />food, and car wash facility; Staff is recommending the Board of Adjustment table action on the <br />variance request until the Planning Commission has reviewed and made a recommendation to the <br />City Council on the proposed site plan. <br /> <br />Staff has included a resolution for both denial and approval for the Board of Adjustment's <br />consideration. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #02-08-__ adopting Findings of Fact # <br />variance from landscape requirements. <br /> <br />relating to a request for a <br /> <br />-and- <br /> <br />Motion to approve the request for a variance to landscape requirements on the Lot 2, Block 1, <br />Sunfish Commons arid adopt Resolution #02-08-__ declaring terms of same. <br /> <br />-or- <br /> <br />Motion to deny the request for a variance to landscape requirements on Lot 2, Block 1, Sunfish <br />Commons based on the findings of fact. <br /> <br />Review Checklist: <br />City Attorney <br />Community Development Director <br />Principal Planner <br /> <br />BolA: 8/29/02 <br /> <br /> <br />
