CASE #: ~,~ <br /> <br />REQUEST FOR A VARIANCE TO LANDSCAPE ARE, A REQUIREMENTS; <br />CASE OF FARIBORZ YAMOUTPOUR <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />Fariborz Yamoutpour is requesting a variance to the 20-foot landscape area requirement adjacent <br />to public roads established in City Code on Lot 2, Block 1, Sunfish Commons, located at the <br />intersection of U.S. Highway 10 and County Road 57 (Sunfish Lake Blvd.). <br /> <br />The Applicant is proposing to develop a convenience store with gasoline pumps, car wash, and a <br />fast food facility on the subject property. The Planning Commission will be reviewing the site <br />plan for the proposed development after the Board of Adjustment meeting on August 1, 2002 <br />meeting. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />e) <br />f) <br />g) <br /> <br />Site location map <br />Site plan <br />Letter from Jack Ovick <br />Proposed findings of fact <br />Proposed variance for approval <br />Proposed variance for denial <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff notified property owners within 350 feet of the subject <br />property of the request for variance and public hearing. <br /> <br />Observations: <br /> <br />The site plan is proposing to construct concrete curing approximately 10.6 feet from the property <br />line along Sunfish Lake Blvd. In accordance with the approved plat of Sunfish Commons the <br />subject property is required to provide an eight foot bituminous trail along Sunfish Lake Blvd. <br />The site plan is proposing to locate the eight foot bituminous trail one foot from the right-of-way <br />line of County Road 57. The western edge of the trail will be bounded by concrete curbing for <br />approximately 180 feet, which also defines the eastern edge of the maneuvering area to the <br />gasoline pump approach (see attached site plan). Bicycle design standards, established by <br />MnDot, requires a minimum 1.6 foot buffer between the edge of the trail and face of the curb. <br /> <br /> <br />
