CASE # <br /> <br />REQUEST FOR A VARIANCE TO THE FRONT YARD SETBACK AND TO <br />CONSTRUCT AN ACCESSORY STRUCTURE CLOSER TO THE FRONT PROPERTY <br />LINE THAN THEPRINCIPAL STRUCTURE; CASE OF CINDI AND MICHAEL <br />HEYING <br /> By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />Section 9.20.11 of the Ramsey City Code states that for lots zoned as R-1 Single Family (Rural <br />Developing) the front yard setback shall be .forty (40) feet and Section 9.11.02 states that no <br />accessory structure shall be constructed closer to the front property line than the principal <br />structure. Mr. and Mrs. Heying are proposing to construct an accessory building with a front <br />yard setback of thirty-three (33) feet (resulting in the accessory structure resting seven feet closer <br />to the front property line than the principal structure) on the property located at 17211 Willemite <br />St. NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site Plan <br />c) Pictures of Property <br />d) Proposed Findings of Fact Resolution <br />e) Proposed Variance Resolution <br />f) Proposed Denial Resolution <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to send notification of the variance request and <br />public hearing to all owners o£property within 350 feet of the Subject Property. <br /> <br />Observations: <br /> <br />The subject parcel is 0.95 acres in size and is zoned R-1 Single Family. City Code has <br />established forty (40) feet as the front yard setback in the R-1 (Rural Developing) district. The <br />principal dwelling is located 40 feet from the front property line. The proposed detached <br />accessory building will be approximately 33 feet from the front property line. <br /> <br />The Site plan submitted reveals that there are several constraints on the property restricting the <br />applicants from meeting the front yard setback. On the north end of the property, there is a <br />seventy-five (75) foot Northern States Power Company easement for transmission lines. A drain <br />field and alternative septic location are located on the east side of the principal dwelling. <br /> <br /> <br />
