CASE # <br /> <br />REQUEST FOR A VARIANCE TO THE sIDE YARD SETBACK; <br /> CASE OF KEVIN AND CHRISTINE GRAPHENTEEN <br /> By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />En route to another inspection, the Building/Fire Inspector noticed that the construction of an <br />accessory structure, located at 14670 Fluorine St., was encroaching into the side yard setback for <br />comer lots. The Building Inspector contacted the property owner, Mr. Graphenteen, to inform <br />h/m of the setback requirements. According to Mr. Graphenteen, he had previously come into <br />City Hall and was informed that an accessory structure of this size, an 8' x I2' (96 .square feet) <br />shed, did not require a building permit. Also, that because it was less than I20 square feet, it was <br />not subject to any setback regulations (he was told only to keep it off of the property line). The <br />Building Inspector than contact'ed the Community Development: department and a site inspection <br />was conducted. During the inspection, it was evident that the accessory structure was being <br />constructed too close to the side yard property line (roughly four feet from the property line). <br /> <br />Mr. and Mrs. Graphenteen have since applied for a variance to the side yard setback for comer <br />lots, in order to keep the accessory structure in its current location. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Site pictures <br />d) Letter from the Applicants <br />e) Petition of Support from neighbors <br />f) Proposed Findings of Fact <br />g) Proposed resolution to den~, variance <br />h) Proposed resolution to approve variance <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff' sent out notices to all property owners within 350' feet. <br /> <br />Observations: <br /> <br />City Code requires a thirty (30) foot side yard setback on comer lots for both principal and <br />accessory structures. The Applicants' accessory structure currently sits about four (4) feet from <br />the side property line..~.jThe subject property is bounded by I46th Avenue to the north and <br />'Fluorine Street to the east (it is pie shaped, narrowing to a point at the 'West edge). The <br />Applicants placed the shed in its' current location in an attempt to leave adequate space to install <br />a deck off of the back of the house that would not overlook the accessory structure. <br /> <br />21 <br /> <br /> <br />
