this Shoreland Overlay District is 50 feet. And, as part of the platting process, Anoka County is <br />requesting an additional 27 feet of right-of-way be dedicated on the plat for CountylRoad #27. <br />The combination of the extra County right-of-way requested and the setbacks from the ordinary <br />high water mark and County roads in a shoreland overlay district eliminates the possibility of a <br />building pad on a lot that exceeds the minimum lot size for the Shoreland District by 30,500 <br />square feet. <br /> <br />Rogers Lake also extends into Burns and Oak Grove. Those communities have classified Rogers <br />Lake as a Recreational Development Water, for which the structure setback from ordinary high <br />water mark is 1.00 feet. Gity Staff is currently drafting an ordinance to update Chapter 9 (Zoning <br />and Subdivision of Land) of the Ramsey City Code. Staff will be proposing for purposes of <br />consistency, to reclassify Rogers Lake within the City of limits of Ramsey to a Recreational <br />Development Water, like Oak Grove and Burns. Also, Staff will be propOsing to eliminate the <br />50 foot setback from County roads in Shoreland Overlay Districts. 'Staff is of the opinion that <br />this extra 10 fee~ of setback, over and above the standard 40 foot setback, is not warranted as the <br />40 foot setback is measured 60 feet from the centerline of any CoUnty road. <br /> <br />Mr. Carmer has presented images from the U.S. Geological Survey that he obtained on the <br />internet. The images seem to indicate that all or most of the existing homes around the lake <br />encroach on the 100 and 200 foot setbacks established in the 3 communities. However, this <br />information cannot be verified. Mr. Canner is requesting that a 75 foot setback from the ordinary <br />high water mark be established for this new lot so that his daughter's home can be placed <br />comparable to existing homes around the lake. <br /> <br />Recommendation: <br /> <br />Staff is not in favor of approving 1.25 foot variance to the current 200 foot structure setback from <br />the ordinary high water mark of Rogers Lake. However, Staff is of the opinion that it is <br />preferable to grant some amount of variance to the Rogers Lake setback and maintain the <br />standard 40 foot setback from the County fight-of-way. The recommendation is to grant a 100 <br />foot variance to the 200 foot ordinary high water mark setback and a 10 foot variance to the 50 <br />foot County road setback. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #02-11-__ adopting Findings of Fact #~ relating to a request <br />from Ronald Canner, Jr. for a variance to Section 9.21.04 of the Ramsey City Code regarding the <br />setback from 'the ordinary high water mark and the County road in the Rogers Lake Shoreland <br />Overlay District. <br /> <br />-and- <br /> <br />2 <br /> <br /> <br />
