Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-11- <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FROM KEVIN AND CHRISTINE GRAPHENTEEN FOR A VARIANCE TO <br />THE SIDE YARD SETBACK FOR CORNER LOTS ON THE PROPERTY LOCATED <br />AT 14670 FLOURINE ST..NW. <br /> <br /> WHEREAS, Kevin and Christine Graphenteen, hereinafter referred to as "Applicants," <br />have properly applied for a Board of Adjustment variance from Section 9.20.11 of the Ramsey <br />City Code to construct an accessory structure that encroaches twenty-six (26) feet into the side <br />yard' setback for comer lots, on the property generally known as 14670 Fluorine St. NW and <br />legally described as follows: <br /> <br />Lot 11, Block 2, Sunny Ponds 3rd Addition, Anoka County, MinnesOta <br />("Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicants appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City, Code on November 7, 2002, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />2. That the Subject Property is zoned R-1 Residential and is approximately .3 acres in size. <br /> <br />3. That the Subject Property is .surrounded by properties zoned R-1 Residential. <br /> <br />That Section 9.20.11 of the Ran~se.y City Code requires a 30froot side yard setback for <br />comer lots. <br /> <br />5. That the Subject Property is an irregular shape (triangular). <br /> <br />That the Applicants have constructed an 8' x 12' accessory structure, which is ninety-six <br />(96) square feet in size, approximately four (4) feet from the side yard property line. <br /> <br />That the Applicants have stated that upon inquiring at City Hall, they were informed that no <br />building permit or setback regulations applied to accessory structures that are less than 120 <br />square feet. <br /> <br />That the Applicants have stated that special conditions, namely the narrowness of the <br />property, are causing an undo hardship. <br /> <br /> <br />
