Absent: Board Members Johnson and Sweet. <br /> <br />Case #2: <br /> <br />Request for a VarianceJfrom Street Frontage or Lot Width Requirements; <br />Case of Bruce and Carol Buchart <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7':20 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public'hearing to order at 7:20 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that Bruce and Carol Buchart are requesting a <br />variance to the minimum lot width or street frontage requirement in order to build a home on a lot <br />they purchased at 8110 173ra Avenue N.W. As some of the Board members may recall, the Board <br />of Adjustment approved a variance from the minimum street frontage requirement for thi~ lot on <br />July 7, 1998. However, no building permit was applied for within the one-year time frame and the <br />variance expired on July 7, 1999. The owner of the property applied for a renewal and the Board of <br />Adjustment approved it on September 4, 2000. Again, no building permit was applied for within the <br />one-year time frame and the variance expired. The property has now been sold to Bruce and Carol <br />Buchart and they are prepared to commence construction this year. City Code does not permit the <br />development of a home on a lot that does not meet the minimum width requirements. City Code <br />defines width as the amount of property that abuts the public road. In the rural residential district, <br />the minimum lot width or street frontage requirement is 200 feet. The subject property abuts <br />County Road #63 at two locations; one measurement is 70 feet and the other is 150 feet. In total, <br />the parcel has 220 feet of non-contiguous street frontage. City Staff recommends re-issuance of the <br />variance from street frontage requirements contingent upon the applicant entering into a variance <br />agreement with the City. The proposed variance is identical to the one approved in 1998 and 2000. <br /> <br />Citizen Input <br /> <br />The Commission noted for the record, receipt of a letter from Kurt and Judy Dey of 8240 173~a <br />Avenue NW, opposing the request for variance. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Reeve, to close the public hearing. <br /> <br />Board of Adjustment/September 10, 2001 <br /> Page 4 of 8 <br /> <br />9 <br /> <br /> <br />
