Chairperson Nixt introduced the following resolution and moved for its adOption: <br /> <br />RESOLUTION #01-09-322 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME <br /> <br /> WHEREAS, Kelly Hemp ("Permittees") have properly applied for a variance from <br />minimum street frontage or lot width requirements in order to construct a dwelling on the <br />property legally described as follows: <br /> <br />The Southeast Quarter of the Northeast Quarter of Section 4, Township 32, Range 25,. <br />Anoka County, Minnesota, EXCEPT the east 528.00 feet of the north 659.64 feet thereof <br />as measured along the north line and east lines thereof, and EXCEPT the west 330.00 feet <br />thereof as measure along said north line. <br /> <br />Together with an ingress and egress easement over and across the west 66.00 feet of the <br />east 528.00 feet of the Northeast Quarter of the Northeast Quarter of said Section 4 and- <br />the north 50.00 feet of the west 66.00 feet of the east 528.00 feet of the said Southeast <br />Quarter of the Northeast Quarter. <br /> <br />("Subject Property") <br /> <br /> WHEREAS, the Board of AdjuStment met on September 4, 20011, condUcted the public <br />heating and adopted findings of fact. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0572, a variance from minimum street frontage and lot width <br />requirements to construct a dwelling on the Subject Property is hereby granted contingent <br />upon the Permittees providing the City with verification that a private easement for access <br />purposes to County Road No. 64 has been granted and recorded at Anoka County property <br />records. <br /> <br />This variance shall automatically expire if it is not initiated by September 4, 2002, and <br />application for building permit shall constitute initiation. The Permittee may petition for an <br />extension of time in which to complete the variance. Such' extension shall be requested, in <br />writing and filed with the City at least 30 days before the expiration of the original variance. <br /> <br />The Subject Property is eligible for building permits for one dwelling unit and related <br />accessory structures in accordance with City Code and no further building permits for <br />additional residential structures will be issued until such time as the Subject Property is <br />replatted in accordance'with City Code and access is provided via a public road improved to <br />City standards. ~ <br /> <br />4. The Permittees shall make a reasonable effort to locate the residential structure and any <br /> accessory buildings constructed on the Subject Property so as not to interfere with the orderly <br /> <br />15 <br /> <br /> <br />
