Absent: None. <br /> <br />BOARD BUSINESS/PUBLIC HEARINGS <br /> <br />Case #1: <br /> <br />Request for a Variance to the Setbacks in the Shoreland Overlay District of <br />Rogers Lake; Case of Ronald Canner, Jr. <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:09 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearin~ <br /> <br />Chairperson Nixt called the public hearing to order at 7:09 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated Ronald Canner, Jr. is in the process of platting a <br />2.5-acre lot from the family homestead located north of 179th Lane N.W. (County Road #27) and <br />east of C.S.A.H. #7. The minimum lot size is 80,000 square feet; the proposed lot will be <br />approximately 110,500 square feet in size. In Ramsey's City Code, Rogers Lake is classified as <br />a Natural Environment Water, for which there is a structure setback from ordinary high water <br />mark of 200 feet. The structure setback from a County road in this Shoreland Overlay District is <br />50 feet. And, as part of the platting process, Anoka County is requesting an additional 27 feet of <br />right-of-way be dedicated on the plat for County Road #27. The combination of the extra <br />County right-of-way requested and the setbacks from the ordinary high water mark and County <br />roads in a shoreland overlay district eliminates the possibility of a building pad on a lot that <br />exceeds the minimum lot size for the Shoreland District by 30,500 square feet. Rogers Lake also <br />extends into Burns and Oak Grove. Those communities have classified Rogers Lake as a <br />Recreational Development Water, for which the structure setback from ordinary high water mark <br />is 100 feet. City staff is currently drafting an ordinance to update Chapter 9 (Zoning and <br />Subdivision of Land) of the Ramsey City Code. Staff will be proposing for purposes of <br />consistency, to reclassify Rogers Lake within the City limits of Ramsey to a Recreational <br />Development Water, like Oak Grove and Bums. Also, Staff will be proposing to eliminate the <br />50-foot setback from County roads in Shoreland Overlay Districts. Staff is of the opinion that <br />this extra 10 feet of setback, over and above the standard 40-foot setback, is not warranted as the <br />40-foot setback is measured 60 feet from the centerline of any County road. Mr. Canner is <br />requesting that a 75-foot setback from the ordinary high water mark be established for this new <br />lot so that his daughter's home can be placed comparable to existing homes around the lake. <br />Staff is not in favor of approving a 125-foot variance to the current 200-foot structure setback <br />from the ordinary high water mark of Rogers Lake.
