preferable to grant some amount of variance to the Rogers Lake setback and maintain the <br />standard 40-foot setback from the County right-of-way. The recommendation is to grant a 100- <br />foot variance to the 200-foot ordinary high water mark setback and a 1 O-foot variance to the 50- <br />foot County road setback. <br /> <br />Citizen Input <br /> <br />Brian and Laurel Jones introduced themselves as the future owners of the lot in question. Mr. <br />Jones noted that there is a one year deadline to get a building permit before the variance expires <br />and requested the variance expiration be extended two or three years since they are not certain <br />they will be in a position to build within a year. Mr. Jones provided the background to their <br />request for a 125-foot variance and 75-foot setback, or a 25-foot setback from the proposed new <br />rule. He noted the map on display identifies the setbacks for houses on this end of the lake in the <br />City of Ramsey. He provided details of each property, noting one house is 40 feet from the lake <br />and only two are set back more than 100 feet and are located closer to the road. He pointed out <br />the location for their future house and noted it is an irregularly shaped triangle lot so an <br />additional 25 feet would provide them with more options to site the house. He stated this is <br />consistent with other houses on this lake and would set no precedence since this is the last <br />buildable area on the lake. <br /> <br />Board Member Brauer asked if they have already purchased the lot. <br /> <br />Mr. Jones explained that they have joint ownership with the family and purchased a 25% share of <br />it from the estate five to six years ago. Now they want to split it apart and his sister-in-law will <br />own the larger portion and they will own this portion. The variance is needed in order to split it <br />since they do not know the value of the lot until it is determined whether it is buildable. He <br />stated the 100-foot setback recommended by staff would provide a buildable lot but the <br />additional 25-foot setback (total of 125 foot) would provide them with more options on where to <br />site the house. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Johnson, to close the public hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Kociscak, <br />Reeve and Watson. Voting No: None.
