Community Development Director Frolik explained that if the City is successful in reclassifying <br />this to a Recreational Development Lake, the DNR recommended setback is 100 feet so the <br />home would be in conformance with the new rules. She advised that the DNR sent notice that <br />they could support a setback of 100 feet as long as there is no clear cutting adjacent to the <br />shoreline. <br /> <br />Board Member Johnson stated that it appears it would not make sense to consider more than 100 <br />feet since that is the setback on the other portions of the lake. <br /> <br />Chairperson Nixt asked for staffs recommendation on the request to extend the expiration of the <br />variance. <br /> <br />Community Development Director Frolik stated she would support that request for extension as <br />it appears to be practical to do so. <br /> <br />Board Member Johnson asked the applicant if there is anything unique about the property that <br />would argue for several more feet over the staff recommended 100-foot setback. <br /> <br />Mr. Jones stated his request for 125 feet is a rather arbitrary number and there is nothing unique <br />to the lot to argue for anything additional. However, 125 feet would allow them to keep more <br />woods and locate the house farther from the point. Then the house would also be more centered <br />on the lot. Mr. Jones stated another potential issue is to be farther away from Highway 7. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Kociscak, to adopt Resolution <br />#02-11-280 adopting Findings of Fact #0636 supporting the request from Ronald Canner, Jr. for <br />a variance to Section 9.21.04 of the Ramsey City Code regarding the setback from the ordinary <br />high water mark and the County road in the Rogers Lake Shoreland Overlay District. <br /> <br />Further discussion: Chairperson Nixt asked about the DNR request for shore preservation. Board <br />Member Johnson stated he did not include that in his motion since the classification of the lake <br />will be changed and new standards would apply. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Kociscak, Brauer, <br />Reeve, and Watson. Voting No: None. Absent: None. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Kociscak, to approve the <br />request from Ronald Canner, Jr. for a variance to Section 9.21.04 of the Ramsey City Code as <br />recommended by City Staff regarding the setback from the ordinary high water mark and the <br />County road in the Rogers Lake Shoreland Overlay District and adopt Resolution #02-11-281 <br />declaring terms of same, as amended to extend the expiration date two years (to 2004). <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Kociscak, Brauer, <br />Reeve and Watson. Voting No: None.
