Principal Planner Trudgeon stated he had a correction on fact number eight, he wrote it as 139th <br />Lane and it should be 140th Avenue and would carry over to the variance also. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Reeve, Brauer, and Kociscak. <br />Voting No: None. Absent: Board Members Johnson and Watson. <br /> <br />Chairperson Nixt stated there is a twenty-foot landscape buffer with forty-feet total. There <br />should be a provision that it is a variance to the landscape size but not required plantings. <br /> <br />Principal Planner Trudgeon stated the forty-foot buffer should be taken out so there is not any <br />confusion. <br /> <br />Motion by Board Member Nixt, seconded by Board Member Brauer, to approve the request for a <br />variance to landscape requirements on Lot 97, Block 1 and Outlot A, Mallard Ponds and adopt <br />Resolution #02-10-256 declaring terms of same and along the eastern and northern areas of the <br />property lines shall include the required plantings consistent with City Code determined without <br />the granting variance. <br /> <br />Motion carried.
