Ms. Harriett Jansen, 14052 140th Court in Mallard Pond, stated the office building is much more <br />appropriate for this residential area and she strongly urged the Board to consider it. <br /> <br />Motion by Board Member Nixt, seconded by Board Member Kociscak, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Kociscak, Brauer, and Reeve. <br />Voting No: None. Absent: Board Members Johnson and Watson. <br /> <br />The public hearing closed at 7:29 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:29 p.m. <br /> <br />Motion by Board Member Nixt, seconded by Board Member Reeve, to adopt Resolution #02-10- <br />255 adopting Findings of Fact relating to a request for a variance from landscape requirements. <br /> <br />Further discussion: Board Member Kociscak stated he preferred the office building and his only <br />problem with this was that this is the same owner as before and they should of planned it better <br />when the first addition was built. <br /> <br />Chairperson Nixt stated he believed if they looked back and followed it through, 140t~ Avenue <br />had an impact on this property because they needed to try to fit properly the Mallard Homes <br />Townhome Development. He stated there are some unique facts that apply to this property that <br />he is willing to look at as not being applicant created. <br /> <br />Board Member Kociscak stated he did not have a problem with granting the variance but this <br />could have been developed better to begin with. <br /> <br />Chairperson Nixt asked if there is planned further development to the east. <br /> <br />Principal Planner Trudgeon <br />Townhome Association and <br />supposed to be green space. <br /> <br />stated this is held in common ownership by Mallard Ponds <br />them was never any approved plan for this area because it is <br /> <br />Chairperson Nixt asked what the size of the area was. <br />Principal Planner Trudgeon stated he was not sure but directed them to a map in the packet. <br /> <br />Chairperson Nixt stated it was a third of an acre at most and would only be able to support one <br />residential house. <br /> <br />Board of Adjustment/October 10, 2002 <br /> Page 5 of 6 <br /> <br /> <br />
