Chairperson Nixt stated there are other uses that could be put into the building but were not the <br />best types of businesses in that area. <br /> <br />Mr. Bulow stated this was true but would not be appropriate for the neighborhood. <br /> <br />Board Member Reeve asked why they could not push the thirty-five feet to the south towards 116 <br />and how much of the required twenty feet green space is the building extending into. <br /> <br />Mr. Bulow stated ten on the north and twenty on the east. <br /> <br />Board Member Reeve asked why they could not shove this over to the west more so there would <br />not be as large of a variance. <br /> <br />Chairperson Nixt stated either way they would have to give a variance to landscape requirements <br />on the east side of the property and if they did this they would need to give a variance for the <br />setback requirement. <br /> <br />Board Member Reeve stated he would rather give a variance to the west and south. <br /> <br />Mr. Click stated one of the reasons staff did not have them move it is because one of the <br />townhomes is set one hundred feet back where it is now and that is why it was not pushed to the <br />left. <br /> <br />Chairperson Nixt stated his suggestion would be to approve the variance contingent on the site <br />plan or sketch plan but provide for the level of screening that would accommodate what they are <br />trying to accomplish. This would accommodate the seven parking stalls and provide some <br />vegetative screening. He stated he would rather see this as an office building because of the <br />residential aspect. <br /> <br />Principal Planner Trudgeon stated there is an eight-foot bituminous trail along the edge of the <br />property. <br /> <br />Ms. Deloris Marlow, 14025 Argon Street, Mallard Pond Townhomes, asked how it is determined <br />on the zoning and how are the residents notified of what is going in there. She stated they have <br />not had any notification of this going in. <br /> <br />Principal Planner Trudgeon stated when the property was originally developed, as part of <br />Flintwood Hills 2nd Addition, it was designated as a furore commercial lot and it has always been <br />the intention of the landowner and the City that this would be developed as commercial property. <br />Ms. Marlow stated they did not know that it was zoned commercial property until a sign went up. <br />Chairperson Nixt asked if she had any comment on the use. <br /> <br />Ms. Marlow stated that she would rather see it as a one-story office building instead of a fast <br />food restaurant or gas station. <br /> <br />Board of Adjustment/October 10, 2002 <br /> Page 4 of 6 <br /> <br /> <br />
