10. That, if granted, the variance requested is the minimum variance necessary to accomplish <br />the intended purpose of the Permittee. <br />11. That, if granted, the variance will not grant the Permittee any special privilege that is denied <br />to the owners of other land in the same district. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />CONDITIONS <br />1. That a Variance to the required paving and parking setback from street right-of-way is <br />hereby granted in accordance with the plans prepared by Hakanson Anderson and dated <br />July 20, 2017, revised August 3, 2017, contingent upon compliance with the Staff Review <br />Letter dated August 28, 2017. <br />2. That the Permittee shall be responsible for obtaining a Conditional Use Permit for the <br />expansion of a lawful, non -conforming use on the Subject Property. <br />4. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Variance. <br />5. The Variance shall become null and void if the use is not initiated by September 7,.2018 <br />and pavement installation shall be considered initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner Van <br />Scoy, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Bauer <br />Commissioner Anderson <br />Commissioner Van Scoy <br />Commissioner Gengler <br />Commissioner Nosan <br />Commissioner Surma <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />Resolution #17-09-217 <br />Page 3 of 5 <br />
