Chairperson Nixt asked what the properties to the north were zoned before the Comprehensive <br />Plan review. <br /> <br />Community Development Director Frolik indicated they were medium-density then, just as they <br />are now. <br /> <br />Commissioner Brauer asked if as the owner of the property, Mr. Raudio would rather see an <br />office building here. <br /> <br />Mr. Raudio indicated he would, because it would not have night life and would have fewer <br />problems with traffic; but that proposal is gone now because of the incorrect zoning. <br /> <br />Ms. Blakely asked for an explanation on the process of notification when land rezoning takes <br />place. <br /> <br />Chairperson Nixt indicated just because something is zoned industrial today does not mean it <br />cannot be single-family residential tomorrow, but the question he has is as the property sits <br />today, should it be commercial or should it be medium-density residential. He stated in his <br />opinion an office would be better than medium-density on Highway 47, but without knowing <br />what the plan is he cannot say it will be an office. <br /> <br />Commissioner Johnson stated this is a difficult case because both parties have valid cases and <br />concerns and both types of zoning make sense for this parcel. <br /> <br />Ms. Blakely asked previous to the residential zoning, how much of the cul-de-sac area was <br />commercial. <br /> <br />Community Development Director Frolik indicated it was all commercial, but when it changed, <br />one lot was left commercial because of Highway 47, however sometime between 1993 and 1998 <br />it was mistakenly changed on the zoning map. <br /> <br />Ms. Blakely asked if any of the Planning Commission members were going to purchase a home <br />in the cul-de-sac and they knew it could be a commercial enterprise next to them, how appealing <br />they would think it would be. She stated they are willing to compromise, understanding the <br />owner needs to recoup some of his costs. <br /> <br />Chairperson Nixt clarified she was saying she would prefer an office building over medium- <br />density residential, but medium-density residential over a convenience store. <br /> <br />Mr. Raudio indicated the first he heard of the change in zoning was when he found out his buyer <br />could not build here, even though he is paying commercial taxes on the property. He stated he <br />contacted Staff and was told he did not have to be notified of this change. He indicated the City <br />has taken something from him without notification, and it needs to be straightened out. <br /> <br />Planning Commission/September 2, 2004 <br /> Page 8 of 14 <br /> <br /> <br />
