Glenn Hardin, manager of Village Bank, introduced himself, Bill Rue and Diane Hughs. <br />Chairperson Nixt asked if they were comfortable with the conditions mentioned this evening and <br />the conditions outlined in the Staff Review Letter. <br />Mr. Hardin stated their only concern was the landscaping. He indicated if they could have <br />flexibility with that for this fall they would appreciate it, and they will certainly work with <br />Mn/Dot on any drainage permits that may be needed. <br />Chairperson Nixt asked if they intend to bring forth an application to construct a permanent <br />facility immediately in the spring. <br />Mr. Hardin stated that is their intent. <br />Motion by Chairperson Nixt, seconded by Jeffrey to close the public hearing at 7:15 p.m. <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Jeffrey, Brauer, Shepherd, Van <br />Scoy and Watson. Voting No: None. Absent: Commissioner Johnson. <br />Commission Input <br />Chairperson Nixt noted that in the mixed use zoning there is a percentage of residential and non- <br />residential required. He asked if the calculations have been done to ensure compliance for this <br />zoning district. <br />She indicated they look at the whole project area as a mixed -use site, rather than each property <br />individually. She noted this is really the second phase of a multi -phase project. She advised the <br />Code reads that no more than 75% shall be of one use. She indicated Staff will monitor the <br />phases to ensure compliance. <br />Motion by Chairperson Nixt, seconded by Commissioner Jeffrey to recommend that City <br />Council adopt Findings of Fact favorable to the applicant relating to a request for an Interim Use <br />Permit to place a temporary modular structure that will be utilized for banking related operations <br />until December 31, 2005. <br />Chairperson Nixt noted two corrections to the Resolution that should be made; Item 4 should say <br />... install a modular structure on the Subject Property.'; and Item 6 should say `...serves the <br />following purposes...'. <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Jeffrey, Brauer, Shepherd, Van <br />Scoy and Watson. Voting No: None.
