Cmx'entty the snowplows are dumping the snow and backing up, and there should be able <br />to be room allocated fbr the snow without a full 60-foot radius. He will agq'ee to put in some type <br />of mtn around for a plow, but he does not think it has to be 60 feet. The other issue is with the <br />ponding. He was at a meeting on October 6'n and ,,vas inforxned by the City Engine,.::r that there <br />are two houses whose lowest floor elevation does now not meet the 100-year flood elevation and <br />he is being asked to fix that. <br /> <br />The Engineer representing TSM Development, Inc. reviewed the elevations and explained TSM <br />Development has added their own pond to help the situation. <br /> <br />Mr. Scbanidt stated the other thing is they are leaving a benin between their pond to protect the <br />bounce. He finds it troubling that when he requested the As Builts for Regency.Ponds he was <br />told the City does not have them. He stated it is not fair for the City to ask hirn to fix a probtern ' <br />from the Regency Pond Development. That is putting a burden on his property. This is a good <br />use o'fthe property and a good fit for the City. He stated they are here on a preliminary` basis and <br />he understands there needs to be more meetings with staff to iron out landscaping, fencing, and <br />the cul-de-sac. Staff has said they need direction from the Council. He would like the Council to <br />table this tonight and set it for the next meeting, and to. direct staff to sit down and iron out the <br />landscaping, fencing, and the turn around without it being a full 60-foot cul-de-sac, which would <br />be a taking. He would like the Council to authorize staffto allow him to start ~ading. He does <br />not plan to do any building until next year and he has time until the final plat is approved to <br />negotiate some of the things with the City. He stated he has gone out of his way to fix problems <br />to the south of him. The Plmming Commission was shocked when they found out the county <br />would not allow access there, and he is trying to accomplish this for everyone. If he is going to <br />construct a privacy fence that is above and beyond the code and that should give him leeway. He <br />is willing to do a brick pillar and wrought iron fencing along CR 56. He was told they might be <br />able to discuss reducing the setback with the cul-de-sac, and this could save a significant number <br />o f trees. <br /> <br />Mayor Gamec indicated cul-de-sacs are a problem for snow plowing, and he would have to think <br />the 60 feet would be require& The landscaping and fencing can be discussed. He commented he <br />understands the access and what the county wants with the outlot. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Strormnen, to table the site plan <br />for CNP Storage, case of TSM Development, Inc., and the preliminary plat of Regency Pond 4~ <br />Addition, to allow staff to work with the developer to come up with a compromise or a~eement <br />to the problems. <br /> <br />Further Discussion: Councilmember Strommen suggested the Council comment on the issues <br />that staff' would like direction on. Associate Planner Geisler requested direction regarding the <br />cut-de-sac. Councilmember Cook suggested a full cul-de-sac with a variance granted on the <br />setback. City Administrator Norman indicated a worksession discussion is needed for the <br />amount of direction that is needed. Mayor Gamec directed staff to place this discussion on the <br />agenda of the next worksession.
