Case #13: Adopt Ordinance to Vacate Easement in Ramsey Town Center Addition; Case of Ramsey Town center LLC CoJnmunity Development Director Frolik advised staff is recommending tabling this case until such time as there is assurance from Rarnsey Town Center LLC that they agree to assume the additional storm sewer construction costs associated with vacating the existing easement. A question was raised as to how long this will be tabled. City Attorney Goodrich replied it will be on the next Council agenda. Motion by Councihnember Elvig, seconded b~y Councilmember Strommen, to table to the next agenda, final adoption of the proposed ordinance to vacate underlying drainage and utility easements in Outlot I, Ramsey Town Center Addition. Motion carried. Voting Yes: Mayor 'Gamec, Councilmernbers Elvig, Strommen, Kurak, Pearson, and Zimmennan. Voting No: Councilmember Cook. Case #14: Consider Introduction of Ordinance to Amend Certain Sections of the City Charter and Schedule a Public Hearing to Review the Proposed Ordinance City Attorney Goodrich advised the Charter Commission met on September 30, 2004, and considered certain housekeeping items to the City Charter. These amendments became necessary as a result of the Charter amendlnents increasing the Council size to seven members and adoption of the Ward System. The ordinance recolmnended by the Charter Cormnission enumerates the proposed changes. The Chapters 3 and 4 amendments are necessitated by the increase of the Council from five to seven members. The Chapter 5 amendments deal with the recall section and provide for recall to be conducted only within the ward represented by the subject Councilmember. The City Charter can be amended by the ordinance procedure as provided in State Statute. This procedure requires that the Charter Comrnission recommend the ordinance to the Council; that the Council conduct a public hearing preceded by two weeks publication of the proposed ordinance; that the ordinance be passed unanimously by the City Council; and that the ordinance not become effective for a period of 90 days after publication in order to permit citizens to petition to have a referendum on the ordinance. The proposed ordinance would schedule the public hearing for November 9, 2004. Motion by Councihnember Cook. seconded by Councilmember Elvig, to introduce an ordinance amending certain sections of the City Charter and to direct the City Clerk to schedule a public hearing for the Council and public to review the proposed ordinance on November 9, 2004.
