Board Member Brauer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-I0-304 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0701 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE TWENTY (20) FOOT PAVEMENT SETBACK <br />FROM PUBLIC STREET RIGHT-OF-WAY. <br /> <br /> WHEREAS, Daniel Druk, hereinafter referred to as "Applicant," has properly applied for <br />a variance from Section 9.20.22 regarding minimum pavement setbacks from public street right- <br />of-way in the B-2 Business District on the property generally known as 9535 Hwy. #10 and <br />legally described as follows: <br /> <br />Lot 2, Block 1, Cowles Addition, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on October 7, 2004, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Subject Property is zoned B-2 Highway Business and the portion of the Subject <br /> Property leased by the Applicant for auto sales is approximately 6,000 square feet. <br /> <br />3. That properties to the east and west are zoned B-2 Highway Business. <br /> <br />4. That the property to the north is railroad right of way. <br /> <br />5. That the property on the south side of Highway #10 is zoned Mixed Use - Planned Unit <br /> Development. <br /> <br />That auto sales is a permitted use in the B-2 Highway Business District provided the <br />driveway, customer/employee parking and vehicle display areas are paved and the perimeter <br />of the pavement is finished with continuous concrete curbing. <br /> <br />7. That section 9.20.22 (B-2 Highway Business District) requires a twenty (20) foot setback <br /> between any pavement and public street right-of-way. <br /> <br />That the Applicant is requesting a variance from the 20-foot pavement setback requirement <br />along Itighway 10 in order to install the required curbing and a bituminous surface within 5 <br />feet of the property line. <br /> <br /> <br />
