1957529 <br /> <br />Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION//04-08-200 ~) '~)~- ~"~-~-I I -~)~ <br /> <br />A RESOLUTION DECLARING TERMS OF VARIANCE TO THE MINIMUM LOT <br />WIDTH, LOT AREA, AND ORDINARY HIGH WATER SETBACK IN THE CRITICAL <br />RIVER OVERLAY DISTRICT. <br /> <br /> WHEREAS, on August 5, 2004, the Ramsey Board of Adjustment issued a variance <br />from Section 9. 21.07 of the Ramsey City Code to permit the construction of a dwelling unit on <br />the properties legally described as follows: <br /> <br />Lot 5 and Lot 6 Bowers Mississippi Acres, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0689, a variance to lot width, lot area, and structure setback from <br />ordinary high water mark is hereby granted in order to construct a dwelling on the Subject <br />Properties. <br /> <br />2. That Lot 5 and 6 will be .63 and .57 in size respectively, and 100 feet in width. <br /> <br />o <br /> <br />That Lot 6 shall not be eligible for a building permit unless the existing homestead located on <br />Lot 5 is demolished or relocated on the Subject Property in a manner that complies with the <br />setbacks established in City Code and the approved variance. <br /> <br />4. That Lot 6 will be eligible for a building permit as such time as Anoka County has assigned a <br /> separate Parcel Identification Number (PIN). <br /> <br />5. That the dwelling units constructed on Lot 5 and 6 shall not be located any closer than 138 <br /> feet from the ordinary high water mark of the Mississippi River. <br /> <br />6. That the Applicant is responsible for obtaining any other regulatory permits required for the <br /> demolition of the existing homestead located on Lot 5. <br /> <br />7. That the dwelling units constructed on the Subject Properties shall not exceed 35 feet in <br /> height. <br /> <br /> <br />
