CASE <br /> <br />DISCUSSION REGARDING DEVELOPMENT STANDARDS FOR PINEVIEW <br />ESTATES 2ND ADDITION PLANNED UNIT DEVELOPMENT (P.U.D.) <br /> <br />Background: <br /> <br />On August 11, 1987, the City Council granted final plat approval to Pineview Estates 2nd Addition <br />P.U.D. The plat consists of 10 dual purpose lots fronting on 149th Avenue N.W., west of <br />Ramsey Blvd. N.W. Under the P.U.D. zoning, the lots were approved to be developed with <br />residential uses on the front 200 feet of each lot and commercial/industrial uses on the remainder of <br />each of the lots. <br /> <br />Recently, I have been approached by persons interested in purchasing these lots regarding what the <br />development standards are for the residential and commercial/industrial portions of the lots. <br /> <br />Observations: <br /> <br />I have reviewed the final plat approval resolution, development agreement and covenants relating to <br />Pineview Estates 2nd Addtion P.U.D. The covenants is fairly specific regarding the development <br />standards for the residential portion of the lots and what the permitted uses will be on the <br />commercial portion of the lots. However, which zoning regulations were intended to be imposed <br />on the commercial/industrial portion of the lots is not addressed. <br /> <br />Recommendation: <br /> <br />I would recommend that since the P.U.D. was extracted from Industrial property and part of the <br />argument for approving the P.U.D. was that it provided a buffer between residential and industrial <br />property, that any issues not specifically addressed in the covenants and its reference to the Site <br />Plan Review section of the Ramsey City Code defer to Section 9.21.26 (Industrial District) and <br />Section 9.10 (Performance Standards) of the Ramsey City Code.
