CASE # 2 <br /> <br />REVIEW PROPOSED REVISION TO SIBBEL ADDITION; <br />CASE OF WERNER SIBBEL <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may recall, on June 4, 1991, the Planning and Zoning Commission reviewed a sketch plan <br />for a minor subdivision to be called Sibbel Addition. In summary, Mr. Sibbel.was proposing to <br />replat the southern 38 acres of his 78 acres to reconfigure the metes and bounds lots as they <br />currently exist. At that time, the Commission recommended that City Council grant final plat <br />approval to the minor subdivision with a 60 foot wide easement along the western boundary of Lot <br />2. The western boundary of Lot 2 was determined to be the most favorable alignment for an <br />easement that was intended to provide for the most reasonable location of a street and resubdivision <br />of Lot 1 when sewer and water are available. The Commission also granted a variance to the <br />minimum street frontage for LOt 1 and approved Mr. Sibbel's proposal to continue to have access <br />to his 40 acre homestead to the north via a private driveway across what would now be Lot 1. <br /> <br />On June 25, 1991, the City Council reviewed the proposed minor subdivision. At that time, the <br />City Engineer recommended that the required easement on the plat be platted as an ouflot to <br />preserve the right-of-way for a possible future road while avoiding a situation of having <br />unimproved, dedicated public streets. At that time, Mr. Sibbel objected to providing for a future <br />street entirely within what was proposed to be Lot 2 of the plat. Mr. Sibbel explained that his son <br />currently resides on Lot 2 and has future plans for accessory structures on the western portion of <br />his lot that would be hindered by the easement. City Council negotiated with Mr. Sibbel and <br />granted final plat approval with the outlot to be centered on the boundary between Lots 1 and 2, <br />access to the northern 40 acres via a private driveway across Lot 1 and a variance to minimum <br />frontage on a public road for Lot 1. <br /> <br />Observations: <br /> <br />Subsequent to obtaining f'mal plat approval, Mr. Sibbel approached City Staff and indicated that he <br />was still opposed to providing any of the required future right-of-way on Lot 2. Mr. Sibbel's <br />surveyor then submitted a proposal to realign the boundary between Lots 1 and 2 further west and <br />provide the future right-of-way all on Lot 1. With the relocation of the interior lot line and the <br />outlot further west, LOt 1 would have lost all frontage on a public road. Therefore, it is proposed <br />that the outlot be dedicated to the City as a drainage and utility easement which would technically <br />still be a part of Lot 1 and thereby retain some frontage on a public road for Lot 1.
