CASE <br /> <br />REQUEST TO VACATE A PORTION OF DRAINAGE EASEMENT LOCATED <br />ON P.I.N. R-20-32-25-12-0004; CASE OF RJS BUILDERS, INC. <br /> By: James Gromberg, Project Manager <br /> <br />Background: <br /> <br />The owner of the property described as Lot 2, Block 3, The North Forty 3rd Addition has <br />requested that the City vacate a portion of the drainage easement covering this parcel. The City <br />Council has directed the Planning and Zoning Commission to conduct a public hearing, review <br />input and make recommendation to the City Council as to the proposed vacation of this portion of <br />the drainage easement. State Statute requires that it be found in the public interest to vacate any <br />public way. In the case of drainage easements or a portion of a drainage easement, this would <br />include if the drainage easement was no longer needed to serve its original purpose under the <br />original grading plan of the subdivision or if the drainage of the area could be best facilitated by the <br />use of currently existing drainage easements. Attached for your information are the following <br />items: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Properties notified list <br />Parcel survey showing portion of drainage easement to be vacated <br />City Engineer's review letter dated November 25, 1991 <br /> <br />Observations: <br /> <br />The Planning and Zoning Commission has tabled vacation of a portion of the drainage easement <br />for the property known as Lot 2, Block 2 of The North Forty 3rd Addition. As stated in the <br />attached review letter by the City Engineer, the easternmost 80 feet of the drainage easement may <br />be vacated without major drainage problems resulting. However, vacating the entire section of the <br />drainage easement would affect the drainage of the subdivision. The City should retain the <br />remaining section of the easement and require it to be graded as proposed. <br /> <br />Recommendations: <br /> <br />City Staff recommends approval of the vacation of the easternmost 80 feet of the drainage easement <br />located on Lot 2, Block 3, The North Forty 3rd Addition. <br /> <br />Commission Action: <br /> <br />Motion to recommend to City Council to approve/deny vacation the easternmost 80 feet of the <br />drainage easement located on Lot 2, Block 3, The North Forty 3rd Addition. <br /> <br />Review Checklist: <br /> <br />City Engineer <br />Project Manager <br />Zoning Administrator <br />City Administrator <br /> <br />PZ: 12/3/91 <br /> <br />II <br /> <br /> <br />
