Section 9.22.07 Of the model ordinance addresses floodway boundary and elevation information to <br />be included [in ~ubdivision plans. We have drafted an ordinance to amend Section 9.50.38, <br />Subdivision ~DeOign Standards, Flood Plain Requirements. Section 9.50.38 is referenced in <br />9.22.07. ' ' <br /> <br />Section 9.2~,08i~ (Public Utilities, Railroads, Roads and Bridges) - Language was added to <br />require that iriew:or replacement on-site water and sewer systems must be designed to minimize or <br />eliminate irffi~ltrz/~on of flood waters into the systems and discharges from the systems into flood <br />waters and thht they shall not be subject to contamination during times of flooding. <br /> <br />Section 9.22.~19 Z (Manufactured Homes and Manufactured Home Parks and Placement of Travel <br />Trailers and ffra~Vel Vehicles) - Language was added to require that the placement of new or <br />replacement, Oangfactured homes be properly elevated to the Regulatory Flood Plain Elevation and <br />that sufficien[ over-the-top or ground anchors be provided. Language was also added to establish <br />under what conditions travel trailers are exempt from the provisions of the ordinance. <br /> <br />Section 9.22.¢0; (Administration) - Language has been added to require the applicant to provide <br />registered certification that the building elevations and flood-proof'rog measures were accomplished <br />~n comphanc¢ w~t~h the ordinance. With regard to variances and condmonal use permits, the t~me <br />frame for re~hirag decisions has been extended from 45 days to 60 days from the date of public <br />hearing adjournr~ent. <br /> <br />Section 9.22;11, (Nonconforming Uses) - Language has been added to decrease the status of <br />nonconformj'~y fr~om 12 months to 6 months when the use is discontinued. Language was also <br />added to reqBir~, that any alteration or addition to a nonconforming structure or use will be <br />protected to't!:tr, e Regulatory Flood Protection Elevation or dry flood proofed. In keeping with the <br />model ordinahcei language has been eliminated requiring nonconforming uses and structures to <br />come into ¢o~fo!'rning with a certain period of time, as determined by City Council, and City <br />Council certification that the nonconforming uses have been flood proofed or otherwise adequately <br />protected. ~ <br /> <br />Section 9.22.]2 -5(Penalties for Violation) - Language has been added to establish a procedure by <br />which violatibns Of the ordinance should be documented and processed. <br /> <br />Section 9.22.~3, (Amendments) - Basically, no change to the procedure for making changes to <br />designation of flOOd plains on zoning map. <br /> <br />RecommendatiOn: <br /> <br />City Staff reCOmmends that the ordinance be moved up to City Council for adoption. <br /> <br /> CommisSion Action: <br /> <br /> Motion to: <br /> Recommend that City Council adopt the proposed ordinance amending Sections 9.22 and <br /> 9.50.38 of the Ramsey City Code. <br /> <br />Review Chee ;Idist: <br /> <br />P&Z: 5/5/92 <br /> <br />City Engineer <br />Zoning Administrator <br /> <br /> <br />
