CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO CONSTRUCT AN <br />ACCESSOR~ STRUCTURE LARGER THAN ALLOWED BY CITY CODE; CASE <br />OF BRIAN AND LAURAL SOHNS <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Brian and Lam'al 8ohns are requesting a conditional use permit to construct an accessory structure <br />larger than City Code allows on their property at 17958 Fluorine Street N.W. Mr. Sohns has <br />indicated in hi8 aPPlication that the structure would be used to store classic cars, and personal lawn <br />and recreation eqmpment. <br /> <br />The following:items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Application <br />Site location map <br />Site certificate of survey <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Observations: <br /> <br />According to City Code as it pertains to the subject property, the accessory structure would be <br />limited to 716 square feet and the total allowable garage and accessory structure space on the <br />property is restricted to 1,488 square feet. Mr. Sohns is proposing to construct an accessory <br />structure that measures 1,064 square feet. The result of this is that the accessory structure would <br />exceed City COde limits for any single structure on the property by 348 square feet and the total <br />allowable gara~ge and accessory structure space on the property by 248 square feet. <br /> <br />The accessory.structure is proposed to be constructed of materials similar in appearance to that of <br />the principal structure on the property. <br /> <br />The applicantis also proposing to construct a second driveway to the accessory structure. City <br />Code does not prohibit second driveways when they access onto City streets. <br /> <br />On numerous occasions, the City has granted approval for accessory structures to be constructed at <br />a size larger ihan City Code allows for. In reviewing past cases, I have found that on two <br />occasions the City denied requests to construct accessory structures larger than allowed by City <br />Code. In one case, the request was for a structure measuring 1900 square feet on a one acre lot; <br />Council felt th~ ptDposed structure size was too excessive for the size of the lot. In the other case, <br />the applicant already had an 1800 square foot accessory structure on the one acre lot. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the request. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt Resolution 4/:92-06- adopting Findings of Fact <br /># ., as amended, relating to Brian Sohns request to construct an accessory structure at <br />17958 Fluorine Street N.W. larger than allowed by City Code. <br /> <br />-and- <br /> <br />7 <br /> <br /> <br />
