CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO MAINTAIN A HORSE ON <br />LESS TItiAN THREE (3) ACRES AND CONSTRUCT A METAL ACCESSORY <br />STRUCTURE ON LESS THAN 2.5 ACRES; CASE OF KRISTIE WEINMANN <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />J. Joseph and~Kristie Weinmann reside at 7903 157th Avenue N.W. Their parcel is approximately <br />2.3 acres in size and they desire to construct a metal accessory structure and maintain a maximum <br />of two (2) horses on their property. In accordance with City Code requirements, the Weinmanns <br />have applied :for a conditional use permit to maintain horses on less than 3 acres and construct a <br />metal accessory structure on less than 2.5 acres. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br /> <br />Site location map <br />Site plan <br />Bldg. design plan - Alternative A (wood) and Alternative B (metal) <br />Horse Care Commission meeting minutes dated October 21, 1992 <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />0 bservations: <br /> <br />Even though the Weinmann's property is in what we could refer to as a 2-1/2 acre subdivision, <br />many of the lots are something less than 2.5 acres. The reason for this is because the total property <br />area, including that which would be dedicated as road right-of-way, was taken into consideration <br />when computing the number of lots allowed at the time of platting. It is staff's policy to compute <br />lot area, for code enforcement purposes, based on measurements from property line to property <br />line, exclusive of road right-of-way. The Weinmann property computes at 2.3 acres; code requires <br />2.5 acres for[ the construction of metal accessory structures. In a survey of some of the <br />surrounding ¢ommunities, we have found that Ramsey is the most lenient as far as minimum <br />acreage requi~ed for metal buildings. In addition to that, there are numerous persons in Ramsey <br />with 'almost' 2.5 acres that would have preferred to construct metal buildings, but conformed to <br />the regulations for accessory structures on less than 2.5 acres. <br /> <br />Ramsey City Code states that no structure that houses horses may be located within 50 feet of a <br />place of human habitation and that buildings housing animals shall not be within 75 feet of <br />property lines.~ From the site plan submitted, it appears that the proposed location of the accessory <br />structure meets these requirements. <br /> <br />The proposed fenced in roaming area is approximately .9 acre in size minus the area of the <br />proposed building; one acre of roaming area would be required for two horses in order to be <br />exempt from~providing a manure management plan. The Horse Care Commission has <br />recommended that the City require a manure management plan that would require monthly removal <br />of manure from the property during the spring, summer and fall. <br /> <br /> <br />
