CASE #: 4 <br /> <br />PROPOS _E.D ORDINANCE TO AMEND CITY CODE CHAPTER 9 (ZONING AND <br /> SUBDIVISION OF LAND), SECTIONS 9.02, 9.21.23, 9.50.37, 9.50.50, AND <br /> SECTION 9.50.57 <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In recent weeks we have reviewed the need to amend various parts of the Zoning and Subdivision <br />Chapter. Thc firzt area is an amendment to Section 9.02 (Definitions) to eliminate the opportunity <br />to include r6ad right-of-way when determine minimum lot area and to include a definition for <br />parcel. The second is amendments to Sections 9.50.37, 9.50.50 and 9.50.57 to relative <br />subdivision design standards. The third area is modifying the B-3 Highway Business District to <br />broaden the permitted uses based on performance standards and eliminate the frequency by which <br />conditional use permits would be required. <br /> <br />A copy of proposed Ordinance g92-__ is enclosed. <br />Observations: <br /> <br />The CommiSSion has reviewed the proposed code amendments on two occasions. One of the <br />issues discuSSed' was the fact that with the elimination of conditional use permits for outside <br />display/salesareas and storage areas, the City also would lose the written authority to require a <br />financial gu~antee for the site improvements and a completion date for the improvements. It was <br />suggested that the proposed B-3 District regulations be revised to require a site plan review for site <br />improvements. <br /> <br />Staff was also directed to research the possibility of including language in the B-3 Highway <br />Business District regulations to amortize all nonconforming uses into compliance, relative to <br />required site improvements, within a specified time frame. Language has been drafted to require <br />all sites in the B-3 District to be in compliance with the required site improvements (paved and <br />curbed driveways, customer/employee parking and outside display/sales areas) by January 1, <br />1997. Please!refer to 9.21.23, subd. 4, item #22. I have no basis for this date so it is certainly <br />negotiable arid at the date of this writing, the City Attorney had not issued an opinion on this <br />language. La.nguage has also been included to establish a procedure for applying for extensions to <br />this compliance date. <br /> <br />Recommendation: <br /> <br />City Staff recommends that the proposed ordinance be forwarded to City Council with a <br />recommendation for adoption. <br /> <br /> Commission Action: <br /> <br /> Motion to: <br /> Recommend that City Council adopt Ordinance g92-__ amending Chapter 9, Sections <br /> 9.02, 9.21'.23, 9.50.37, 9.50.50 and 9.50.57. <br /> <br />Review CheCklist: <br /> <br />City Administrator <br />City Attorney <br />Zoning Administrator <br /> <br />PZ: 11/5/92 27 <br /> <br /> <br />
